No, IELTS is not a requirement for SOWP. Even I have got the same notes in my SOWP GCMS notes file.

HI, I NEED AN EXPERT PLS.

I am waiting for our approval in principle. I have been issued an Open Work Permit since 2013. Can I apply a SOWP for my husband who's here in Canada? His work permit will expire this April 2015. Pls. I need your brilliant answer. Thank you :) :) :)

Hi FKL,

I had applied for SOWP on 13th Nov 2014 from India. Did a paper based application. Had not done the medicals.
My visa status now says Passport has been couriered from the Canada Visa Application Centre, on 19/01/2015 .
I have not received any email or anything.

I am confused with this update. Does it mean my visa application has been approved?
I am just hoping for positive news. :-X

I don't know what you mean by approval in principle. Probably you were referring to having applied for some PR program. What is the basis of your Open work permit? If it is a PGWP, then you need to have a NOC 0, A or B job in order for your spouse to be eligible for SOWP. You don't apply for him. He would apply for himself but for a SOWP dependent upon you. If you don't have a Skilled job, then you can't use this route.

Hi Deh,

As far as i know there is no exception for medicals in order to get a successful work permit in India, Pakistan etc.

I am afraid it has to be a rejection if it came without medicals. I am sorry but this is all i know.

I am currently residing in Montreal. I have a Full Time Job of Software Developer and Open Work Permit valid till August-2017.

My fiancee is currently in India. I am planning to go India around April-2015 and do the court Marriage. Then, around November-2015, I am planning to go back and bring my spouse along with me.

I am confused over which visa category should I call my spouse. Should she apply for:

1. TRV from India and apply for OWP after she comes here.
2. Or, should she directly apply for OWP and get TRV along with it?

Senior Member, please advice me. What is the processing time for each case and which option is safest?

What ever way you apply, you are not applying for a visitor trv which is short visit max for six months and does not require medicals. It's processing time is the least one and has a high degree of rejection specifically in cases like yours.

The standard OWP application could take a few months depending upon current processing time at your end embassy is the right way to go. It does not make any sense to reapply for OWP after coming here. Unless the spouse already has a visitor visa through some other means.

You do not get medical coverage on visitor trv. However, being spouse of a skilled worker whether she holds an OWP or a resident trv and is eligible for medical coverage as well for as long as you are here.

Bottom line, apply for SOWP even if she has no plans of working here. Be very very explicit in your job letter PROVING your NOC by detailing out your job duties. Since you have an OWP, you need to prove your job is a skilled one in order for your spouse to be eligible for SOWP or Resident trv.

Glad i could be of help.

If you have enough evidence of your marriage in 2014 when you register it, then it should be fine.

Still i would say you should add her to your PR application BEFORE applying for SOWP. It might get through fine with out that (things look fine on your case), but you never know if a visa officer panics and checks whether she is there on your PR or not. Or you could do both at the same time and let CIC know along.

There can always be a rejection for some xyz reason that one would not have considered. So it is never sure until actually done. But over all your case looks pretty solid. Just that if i were in your place, i would like to add some indication (even a letter that we are just married so i would be adding her to my PR app soon as well) along. That is just my opinion with limited knowledge of dual intent.

Perhaps its better to look at details of dual intent first and see if you could find something useful.

Also, in my experience (and this is what happened to me when i entered the country as a student), the immigration officer at the port of entry looks at all your documents and your TRV in particular and then provides you with a permit - which should be open work permit in my wife's case.

Thoughts ?

Congrats kamatmahesh and you are most welcome. Medical request in general is a very positive sign since more than 90% rejections are done without it. So it is very likely that your case is going smooth and closer to success. Still its not done till done :) So hope for the best.

If approved, she won't just get a trv (assuming you applied for SOWP), she would also receive a work permit approval letter called "Letter of introduction" (similar to what you would have received when you were coming as a student) and that is the single most important document that needs to be presented to CBSA officer to get work permit issued at POE.

Assuming your medicals are crystal clear and they originally were done with security clearance etc. already, it should be with in a month.

But there can be exceptions. E.g. i received a letter by ordinary post A MONTH after medicals concerning some further screening needed for one of my kids. We had almost 3 more trips to medical center + a specialist and almost another 1.5 month to get things through ultimately.

I am in canada for almost 2 years nd i hve dne my diploma in ontario nd moved to alberta, while i was a student i applied SOWP for my husband and got rejected twice stating family ties, financial assests nd will not leave canada in intended time. i have shown all d rrequired documents nd stuff. Now i am on PGWP till 2015 AUgust and working under skilled level NOC B and applied again for my husband (November,10 2014) . Few days back again they rejected stating family ties, financial assests and will not leave canada in intended time

Did you ever apply for gcms notes for rejection? What did those state? If not, i am amazed. That is the first thing you should do.

But i am afraid that if your current permit is only valid till late 2015. Probably if you apply again now, it would be very close to your permit's expiry. So it's better that you find the reasons for refusal, address them, get your principal permit extended or apply for principal permit extension along with the same for spouse.
