Hey,

your friend applied under FSW or CEC?

I think MI 12 refers to FSW.

refer below page

cic.gc.ca/english/department/mi/
In the CEC, MI12 re-set the cap at 8,000 new applications per year, and maintained the existing NOC B occupational sub-caps and six ineligible occupations. Lastly, MI12 renewed the ongoing pauses on the Immigrant Investor Program and the Federal Entrepreneur Program. Read the full text of MI12.

Ministerial Instructions 12 (MI12): Federal Skilled Workers, Federal Skilled Trades, Canadian Experience Class

Effective May 1, 2014, the twelfth set of Ministerial Instructions (MI 12) re-set the application caps for the Federal Skilled Worker Program (FSWP), Federal Skilled Trades Program (FSTP), and Canadian Experience Class (CEC). In the FSWP eligible occupations stream, it established an overall cap of 25,000 new applications and sub-caps of 1,000 applications in each of the 50 eligible occupations. MI12 also re-set the cap for PhD applicants under the FSWP to 500 new applications each year. For the FSTP, the Instructions established a cap of 5,000 new applications per year, with sub-caps of 100 for each of the 90 eligible skilled trades.

Ministerial Instructions 10 (MI10): Canadian Experience Class

On November 9, 2013, new Ministerial Instructions (MI10) were issued to manage the intake of new applications in the Canadian Experience Class (CEC). From November 9, 2013 to October 31, 2014, CIC will accept a maximum of 12,000 new CEC applications. Most National Occupational Classification (NOC) skill level B occupations are further sub-capped at 200 applications each. Work experience in six NOC B occupations can no longer be used to qualify for the CEC. NOC 0 and A occupations are not sub-capped, but are subject to the overall cap of 12,000. M12 comes after M10. So yes M12 incudes all FST,FSW and CEC.
We all are in the same soup.

If the CAP has been reached then CIC would have updated the News on its website.

Canadian Experience Class
Cap and sub-caps on the number of applications to be processed
A maximum of 8 000 new complete applications submitted for the Canadian Experience Class will be considered for processing for the period of May 1, 2014, to April 30, 2015, unless otherwise indicated in a future Ministerial Instruction. Within the 8 000 cap, a maximum of 200 complete applications submitted for each occupation at Skill Level B as per the 2011 version of the NOC will be considered for processing, except in the six occupations specified below. CIC will not consider for processing Canadian Experience Class applications for which the applicant claims work experience in one or more of the ineligible occupations set out below in support of their application, unless the applicant claims qualifying (see footnote 7) work experience in other NOC Skill Type 0, or Skill Level A or B occupations.

Ineligible NOC occupations:

1221 — Administrative officers
1241 — Administrative assistants
1311 — Accounting technicians and bookkeepers
6211 — Retail sales supervisors
6311 — Food service supervisors
6322 — Cooks
Once an application is placed into processing, an officer may refuse an application if the officer determines that the applicant has work experience in one or more of the six ineligible occupations listed above and the officer is not satisfied that the applicant has the required qualifying work experience in other NOC Skill Type 0, or Skill Level A or B occupations.

In all cases, applications placed into processing are still subject to the requirements of the Canadian Experience Class and all other applicable requirements under the IRPA.

For further clarity, there is no sub-cap on the number of new applications submitted at NOC Skill Type 0 or Skill Level A. However, these occupations are subject to the overall cap of 8 000 complete applications.

In calculating the caps, applications will be considered in order of the date they are received. Applications received on the same date will be considered for processing having regard to routine office procedures.

As per my earlier post, CIC is saying cap is calculated based on the order of application recieved. Means if CIC/CEC accepted our applications..that means we fall under CAP.

In calculating the caps, applications will be considered in order of the date they are received. Applications received on the same date will be considered for processing having regard to routine office procedures.

Hey guys, we have only one refused case so far. It cannot be fully trusted. We need to wait for more people to confirm these type of CIC answers.

Unfortunately, that's not the case.
When they received/accepted your application, they have no idea whether your job is in NOC B, thus they won't make the decision whether to refuse or not. So they will receive all the applications, and return the left ones once the cap is reached.
Another reason is, some FSW applications and CEC applications are sent to the same address(I know there is MAIL BOX specifically for CEC, but this happens), in some cases, CIC doesn't even know if you are application through CEC or FSW when they received it.
All in all, our applications being accepted doesn't mean CIC will process them.

I agree with Ivan.Galv,

I will suggest we all have some little patience. Everyone is tensed, i know.

Why not wait till next week Monday for an official announcement from CIC that the CAP is reached. These guys aren't fools or don't have human feelings.

I believe they will send out a press release or something if CAP reached. Meanwhile, grab a bottle of beer and relax. #BePositive
