Spousal sponsorship

Hello all. This may be a beat up question, but I need help as our lawyer is telling me something different than what online research suggests. My father needs to be sponsored by mom (she is a Canadian citizen). She had been practically retired over the last couple of years (i.e. no income). She does own her own condo (literally, no mortgage), has about $50K in savings, and has no debt. My dad's income overseas is high and has been their financial support. However, the lawyer says that sponsoring my dad won't be possible for my mom as she has no income. I argued with her that they a) have enough if a nest egg b) my dad earns a lot c) my dad also, even whole working, has a high pension that can actually be deposited directly to a Canadian account if he so desires and d) if necessary, I will provide any paperwork that I can financially help them if all else fails.
She says that without income my mother is simpy not eligible at all to sponsor my dad (her spouse), even though all research points to a different conclusion. She is pushing really hard for parent sponsorship. But we said no. Her answer was something along the lines of "then application won't be successful".
Is she incompetent or am I missing something?

She is incompetent. There is no specific income requirement to sponsor a spouse or better explained, spousal sponsorship is exempt from specific income requirements. However, immigration still wants to know that they will not end up on welfare so for her finances, your mother should state that she is a homemaker and your father is the breadwinner. She should show his proof of income and their savings and all will be fine.

It's a common misconception. NYC and LA typically only handle "complex" applications (ARCs, TRPs, criminal inadmissibility, interviews, etc.) Thus the processing times are longer. If you don't have any of those things it is likely CPP-O will keep the application.

it's been long time now..........i have sent my spouse visa file to mississauga by Xpress Post and they received it on 9th Dec.. but i have received no information regarding my file from them yet..........m so upset and confused.......plz smbdy do tell me from where can i know smthing............reply soon if smbdy has same case........thnx.

That's not "a long time".

CIC's website says they are working on applications received November 20, 2013. That's a week old, so you're still about 2 weeks away from them making a decision and contacting you. Normally sponsor approval is the first contact you get.

Should I apply inland or outland? It looks to me that it would only take a little over a month to complete if I apply outland.

he searching already, but there was no form 1603. then he called them , cic told him, may be its mistyped bcoz there was no form 1603.

Outland in month? I don't know what outland place you're applying to but that seems very unlikely. It's a month to get sponsorship eligeabilty approval. Then the 2nd part starts

I think your lawyer is trying to extract more money out of you and put you in an unnecessarily long process. This sort of thing makes me so cross. Follow the senior advice. Sorry for your loss I'm sure she's pinched money from you already. I hope not!!!

This is true. Also if you look at the LA forum which is listed as a 26 month wait, and browse the timelines of those who are through, you will see many going through in as little as 5 months or so. Sorry for the previous alarm. Nothing is guaranteed, but it should be quick with a complete and reasonably supported application.

Someone was saying earlier that he wants his wife to do the medical exam before the marriage and he got the answer that he should do that + police certificate when CIC asks for them?

I'm a bit confused, i wanted to do the same thing: i'll submit the application probably just in may 2014 but my canadian husband will stay with me in Romania for the entire months march&april .. so i obviously thought i`ll do the medical exam & ask for the police certificate just a bit before he flies back to Canada, so that he'll submit the application right away (including my medical exam + police certificate).. The reason is obviously because if i send them via post, it will take 3 weeks at least.

But if i`m not mistaking, the medicals can be made through an electronic system so the results are sent right away to CIC (therefore no need to include them in the package?).. but for the police certificates i thought you need to submit them at the same time with all the forms and documents? Indeed the police certificates expire after 3 months :( but i thought it's no problem because they check it before it expires? ;D

I hope someone can clarify this for me. Thanks! :-*
