I've been reading some posts in this forum since about a week, and I found a lot of interesting things. I'm the sponsored one, well I'm going to be because we are just preparing everything for applying outland as soon as we can, we miss each other so much.
I meet my husband two years ago, and we married in Jan. The only thing that worries me is that two years ago I apply for a TRV, which I was denied, the problem is that like in a lot of cases everybody told me not to say he was my boyfriend, so I say he was a family friend, which was true but I didn't say the whole truth. I met him in Jan 2011 we were together for three weeks and start the relationship, he came back to Canada and then he wanted me to apply for TRV two months later, because we want to see where the relationship was going to go and be able to know each other better. I had no idea how hard it can be to obtain a TRV, and I had no idea I was going to be applying for PR and that said he was just my friend now can be pretty bad, because I'm scared they can deny me PR or ban me for two years. So I would appreciate if some of you with all your experience can advise me how to deal with this situation. I have my meds done, and I'm paranoid about everything they can take as a bad thing.

I think there is a condition about having to live in Canada for 3 years out of 5 consistently. So as long as you haven't been living out of Canada for the last 3 years you can go to the Philippines get married and return to start the process.

So, the Sponsor needs to make sure they meet their PR requirements (if he or she is a PR) of 730 days of living in Canada within the past five years rolling. Doing so before they meet residency requirements can trigger an investigation into their PR with the chance they can lose it (and therefore not be allowed to sponsor their spouse - although my husband did try to list me as the Sponsor on his paperwork 8) )

So you mean it is a bad idea that I sponsor him before I finish my 730 days? Although my residence and my immigration in Canada is completely clean and the person I'm sponsoring is completely eligible?

Yeah that's right my husband is my best friend :D, thanks amikety and canadianjeepguy i feel better now, and I'm going to keep working in having my application ready, I want to send the file to my husband soon.

This is why only posting once and having one thread is a good idea. Making multiple threads with, especially with different information is not good because it confuses people and isn't clear.

Just because I've replied to your other thread, I happen to understand you just landed.

Because you have just landed, you still have time to meet your residency requirements. There is no rolling five years yet. You can apply immediately to sponsor.

I don't get what you mean about the rolling five years? I already got my PR Card, does that contribute to anything?

You should read up on residency requirements because they're an important part to maintaining your PR. You can lose it if you don't meet residency requirements. Basically, for every rolling five years, you have to live in Canada for at least 730 days (2 years more or less). What rolling means is the date moves forward as time progresses. Today the rolling five years is 5/9/2008. In August, it will be August 2008. Next January it will be January 2009. It is always moving forward as time does.

You landed only a year ago, so there is no concern here.

I think this is how it works....

Say you became a PR in 2005. Then spent the next 7 years working and living in the Philippines for 10 months out a 12 for every one of those years. Then you decide to return to Canada and live here exclusively. In order to be eligible to sponsor your spouse you would have to have lived in Canada for 2 complete years.

I hope I have that right. If not Amikety will correct me again. :D :D

So you mean, I can't sponsor my spouse if I have only lived in Canada as a PR for 1 year?
bec this will be the sit: I have lived as PR in Canada for 1 year, go home (short period not exceeding a month) and get married, go back and stay in Canada and apply for sponsorship as soon as I get back

No. The 2 out of 5 years applies only when you have lived as a PR outside Canada longer than you have lived inside Canada since you got your PR status. In your case you are free to return home and get married then come back and start the process for your spouse.
