No. "In Process" means that the visa office is actually looking at your file, and it usually does not take the visa office long from that point to make a final decision. In the meantime, if the visa office would rule that you have not been living together for one year, then you will not simply be able to make up the difference with a short visit in Canada -- you'd have to wait at least a year before reapplying.

Additionally, there is no reason that she must wait in Scotland even whilst an outland application is in process; she can still move to visit you on visitor's status and await the final decision on the application from within Canada.

Bigredmoose - We applied under "conjugal". Now that I've researched further, I understand that it was the worst route to take. We've known each other since the spring of 2012 and have visited back and forth countless times in the last three years. We spend approximately twelve weeks a year together (I'm currently in Scotland visiting now). The additional info they requested was to provide more evidence of our relationship. We sent more photos and a large stack of text messages proving that we are serious about living together.

In that case, I would expect your application to be refused, since there seem to be no insurmountable legal barriers to you or your partner obtaining a visitor's visa long enough to form a common-law relationship. Being "serious about living together" is not in and of itself sufficient; you need to have some very serious and documented reason that you cannot live together now.

Still, there is nothing preventing you from going through with your visitor-status plan even while you wait for the refusal. Withdrawing your application will not provide any benefit, since the online status showing "in process" means that you would not be eligible for a refund of the application fee. Letting it go through will not prejudice a subsequent relationship (edit: application), and there's a very very faint possibility that CIC would feel generous about your conjugal partnership application.

I second all this, you made a mistake, but if you can afford it, having her live with you for the year as a visitor is not a big deal, then just reapply. Let the process take its course at this point, perhaps they figured out that you just didn't know what you were doing and will let it slide. Regardless it won't be long now till you know.

Hello everyone,

My first time here asking a question BUT have been following this thread for quite some time now. Everyone here is VERY VERY helpful!

My question is : I applied for my wifes spousal immigration ( I live in Toronto) in Feb 2015, and got "Decision Made" on April 24th, 2015 and now pretty much its just a waiting game I guess. She lives in Dubai, U.A.E , but her papers are in Abu Dhabu . My sister is getting married on August 12, 2015 and I was wondering if I should apply for my wife's TRV? They are childhood best friends and its very hard on her to see her best friend get married and she wont be here!! Will it effect our application in Abu Dhabi IF she gets rejected? And finally if anyone can help me with how I should apply for her TRV (Temporary Resident Visa)?

You guys are great and I have gotten a lot of information from here. !!!

Application for a temporary visa will not affect a permanent residence application, although the PR application may negatively influence the TRV application.

Your dates are about the same as ours....09APR2014...In process 23JUN2015...

There's no harm in applying, but you have to show her connections back in her home country if you want any hope to get approved while doing PR. Jobs, property, family, etc.

Not really what we wanted to hear, but I was sort of expecting it regardless. Bad move on my part for sure.

So here is the plan.

I'm going to come back for a visit the first week of September(her nieces wedding) and stay for two weeks. If we haven't heard by then what the decision is, she is going to come to Canada December 01st. Beginning of April we will apply for an extension of six months and after a year we will re apply for a PRV proving that we have co habituated for a year. Does that make sense?

It sounds like a good plan. If your conjugal application is rejected, you can live together for a year and then apply as common law, like you described. You could also get married to cut out that year of cohabitating and apply as a married couple right away, but that's up to you.

We were told by CIC that if we have to redo medical it will take at least an additional 6 months from the date they recieve them, we did up front Meds. March 2014 and additional meds in Jun2015 and now all has to be redone....our review date is not until Sep2015...so March 2016 maybe.......
