Right, he can apply either before or after or if he is visa exempt, he can also apply on entry. From what I have read, if a family unit or a couple applies together, the visa officers are instructed to see them as a unit and either approve or reject both. However, if he gets the TRV, it is unlikely that he will be denied a work permit once he is inside Canada because if he was considered a risk of overstay, they would not give him the TRV.

Just one more thing-after my studies I will have to have one year work experience in one of the 29 listed occupations

I am so glad to hear that you finally got the OWP. I'm in the exactly same situation as you were. The only difference is my spouse will apply for PGWP in April next year.
Since we came to Canada, my husband has been focused on only his study without working, and I worked for only few months as a part time worker. We thought we both would get the work permit in anyway after my spouse's graduation. It feels like a hammer slam to us when we heard I will no longer be eligible for OWP. As of now, I am holding an OWP now and will attempt to extend it somehow. So, could you possibly tell me what step did you take to extend the OWP. Dear PPON,

I'm new in this forum. But I'm facing the same problem like some of yours. I came to Canada on 2008 Dec. as an international student. My husband joined me on August 2009 and he got his OWP against my study permit. He has been working as a full time employee since January 2010. we have our visa till 2017. I graduated last October and now have my 3 years valid PGWP. I'm looking for a full time professional job now a days. My husband's OWP will be expiring on 28th Feb. 2012. I have no idea how could I extend his work permit now. He is the only earning member in our family. I also noticed that his SIN is expiring with his OWP. We are in Fredericton, New Brunswick.
please suggest what should we do until I get any professional job. Any information from any of the member of this forum will be highly appreciated.

As far as I know, as a spouse of a person on PGWP, he can not get an OWP unless you have a skilled job so hurry up and find one asap. In the meantime, shortly before his OWP expires, apply to change his status to visitor so he will still be allowed to stay with you in Canada.

Are you planning on applying under CEC? If yes, your work experience only has to be skilled. That means the NOC code must either start with 0 (Skill type 0 position) or if it does not, the 2nd digit of the NOC code must be 1, 2 or 3 (Skill level A and B).

If your husband is visa exempt to Canada, send him a copy of your study permit and when he arrives at the border, he can show that and show your marriage certificate and apply for a work permit right away. He also needs $150 to pay for it.

If he is not visa exempt, he can apply for the open work permit and TRV at the Canadian embassy in the country where he lives. He will still have to show that he will not overstay in Canada, same as any other person applying for a TRV.

To be eligible for an Open Work Permit, the spouse or common-law partner of a foreign student cannot themselves be full-time students and must demonstrate that:

* the foreign student is studying full-time at a diploma/degree-granting, publicly-funded post-secondary educational facility; or

* the foreign student has graduated and is the holder of a valid work permit for a job related to his/her studies.



This was given in the Canadian Immigration Essays by Canadian Immigration Lawyer David Cohen. So should i wait until my program gets over to apply/

What are you doing at Tim Hortons? If you are a regular employee, you are probably under 6641 Food Counter Attendants, Kitchen Helpers and Related Occupations and that is not a skilled job. If you are a shift manager, you would be under 6212 Food Service Supervisors which is skilled. A call centre job can be skilled if it is technical support or a supervisor.

These two are skilled:
