It is a tricky question... I had 402 points. when I created the profile in Feb, I had selected NO for the same option even though I was working at that time and have no LMIA (I have open work permit and working in Ontario for 3 years with same employer). But somehow in August I changed it to YES and selected option that I have no LMIA. Ola... I got the nomination from Ontario and currently my application is in process for PR.
Ontario wants ppl who have the absolute intent to work and live here.
