yeah one of the requirements for getting married in Canada is not being married previously so ... it's just not possible to get married in Mexico legally and then in Canada. Not gonna happen.

That's why we keep telling you the marriage is legal if it was done under the law of the two countries.

I think when you are married in other country you only need to register your marriage wherever you want to live in this case register in Canada, like you say getting married twice is not only illegal but it is consider a crime at least in Mexico. Good luck!

Hello guys I just wanna share a little bit of my experience about my process. I got already my Permanente Resident I'm originally from Mexico and my partner is a Canadian Citizen We are a same sex couple and we have barely lived together for 2 years we applied exactly when we became common law partners our relationship was very short and we did not get married we thought we were gonna be called for an interview just for the shortness of the relation ship but everything was smooth and positive in less than 6 months I got approved I believe sometimes is not important if you are married or common law o if you have lived together for years or for a year what it is important is that you prove that is a genuine relation ship and give them at least what they ask that is enough. My advice for all of you is not to worry a lot about more things than they request just make a good application they want proof of the relationship, follow their instructions, Send lots of letters from people that know your relation friends, family, co workers, neighbors, etc Send banks statements ( we don't have joint accounts but we give each other money just proof that so print them and make a relation between the accounts) Pictures ( We printed them at home in regular paper with a caption of the place we were and whom we were with ) even we lived together we sent phone bills just to prove that we call each other regular not for long periods but constantly ) we sent receipts of things we bought for our place like tv, dvd, blender etc also receipst of gits. we also made a will from an internet website that cost 13 dollars and it is legal, if you have insurance, join membership or credit cards ( if you don't have one get one at costco or community centers) what eles??? The most important stay positive if your relationship is genuine even you don't have lots of proof you will find the way to make them believe. Every application is different so just think in yours and use a reference in others if you don't hear from them in the average time contact them, there is nothing wrong being interested in you application. I tell you what I did and it worked for me I hope you find this helpful! Good luck to all my paisanos!

Hi

We applied inland May 2010. We recieved decision made letter 2 weeks ago. They only want state and federal polcie certs. We are aware that the Canadian Embassy in Mexico City will do this for him and all FP etc were sent last week. The problem is the state. They insist he gets them in person. We all know he can't leave Canada. The Mexican Consulate was helpful today. They do a power of attorney and we fedex along with FP, Photos etc to Guerrerro. His brother will onca again act on Jose's behalf and try to obtain his Certicificate. The problem is that The appointment to have the formal Power of Attorny can not be until May 3rd. We will pay 100.00 for that service. When we recieved the decision made letter it stated that we have 90 days to get the police certs. So that takes us to June 10. Let's hope all goes well in Guerrero and we should just make it. I guess I was hoping someone would just tell me that this was all a nightmare and time to wake up. lol...I guess I was hoping someone would say that it would be o.k to skip the state police cert...I guess not...Thanks all...

ohhhh I see.

No, the state police certificates need to be gotten in person because they take a picture and his finger print there on the spot and I don't think there's a way around it. You're better off paying for a WestJet ticket for him to go to Guerrero for a few days. I was in Yucatan and had to travel all the way back to Jalisco to get the certificates from when I lived there.

I think this may vary by state, we were able to get a state police certificate from Coahuila without being physically present. My partner's mom or brother got his and I don't think there was a carta poder involved either. Maybe they knew someone who worked there :).

It does vary. My mother got my Morelos state police certificate with a simple carta poder. I had to send certified fingerprints though.

Thanks everyone. The lady at the Mexican consulate here in Toronto is calling Guerrero today. He would love nothing more than to hop on a plane and go home for a few days but now Mexicans require a visa to enter Canada and he risks all by leaving. He is stuck, so hopefully we get some clear answers today. The good news is that along with the first stage approval came permission to apply for a work permit. It takes 30 days. Thanks again!

this is actually what I meant

http://www.guerrero.gob.mx/?P=tramitedetalle&key=1593

they take his picture there and I'm pretty sure they put a thumb print too

My advice is to wait for the work visa for him to complete his application so he can come back

oh mikeyvr, you're supposed to get the certificate and give it to them ...

I got my letter from the embassy (in Yucatan) about two weeks after they received my application in Mexico city

Jendrian..thanks for the help but unfortunately when you apply inland you can't leave the country until all is final. I wish i was wrong but I have looked into it and the answer is no. Our Immigration lawyer told us that there were a few a countries in Europe that the person can only get the cert so Canada has agreed excuse those Inlanders. Looks like Guerrero will do it with the formal power of attorney....That being said...maybe you can enlighten me...do you think he can leave and come back in without a problem once he receives his work permit??

are you sure the Guerrero government will do it with a power of attorney? I'm quite certain they won't (but I didn't search thoroughly about it). If you can get it without him being physically there then don't leave the country. From what I have read all he needs is to maintain a legal status in Canada for the duration of the process, not to be physically in the country. That means as long as he's legally able to be in Canada for the process (even if he's not), everything's kosher. You can read more about it here:

http://www.cic.gc.ca/english/information/applications/guides/5289E10.asp

Even more so, in that page you may find this line interesting:

CIC said:
On February 18, 2005, the Minister announced a new public policy under which legal immigration status is no longer a requirement for spouses and common-law partners of Canadian citizens and permanent residents in Canada who wish to apply permanent resident status provided that they have an eligible sponsor. However, all other eligibility requirements continue to apply.
So since 2005 he doesn't even need to keep his legal status as long as you're an eligible sponsor (which is why he was admitted and taken to apply for a work visa).

Your best bet is to call this line 1-888-242-2100

Taken from

http://www.cic.gc.ca/english/information/offices/canada/vegreville.asp

For more questions about it.

Hope this helps!

oh btw, you don't need a 100 CAD power of attorney, you just need to sign one and send it to your friend.

I made powers of attorney before leaving Mexico but they're somewhat personalized, if you wish me to give you some with your info let me know and I'll let you know what information is required for the letter and I'll send it to you in a PDF. That paper you'll have to print, sign and send to your friend in Mexico.

Again, I doubt oh-so-much you can do it like that, mainly because the places I've seen where they do this "on the spot" (pictures and fingerprints) they're pretty resilient about special circumstances. I would love to be wrong on this one though.
