Uruguay is not a country that has a high approval rate for refugees and you seem to have applied for asylum because you didn’t qualify for anything else. Random crime committed against you is not grounds for asylum. You have already delayed by not reporting for a year. Assume you may be trying to delay so the baby is born in Canada. If you don’t have a lawyer I would get one if you can afford one but at this point you seem to be on the removal track. Does your daughter even have medical coverage given her status? It is really up to CBSA but given that you didn’t seem to have an asylum case to begin with you have been able to stay in Canada for 5 years you have been very lucky already.
Trust me I know! Im so lucky.
She still have coverage because they give us long years. Before the refugee claim I was admitted to study in 2 colleges but couldn't get my study permit so we used that money to cover expenses when my husband was out of work. All that stuff is on my case and the counselor it's very positive. But unfortunately time is against us now.

Im still hoping for someone to tell me that they where in my position and they got a bit of extra time before deportation. I know it's very unlikely but my whole case was the same and here Im hoping.

No Im not from Mexico, Im from Uruguay.
I do have a immigration counselor, but I was trying to hear from people in similar situations.
My daughter is about to get married, we also know that this wont stop her removal. We are here since 2015, we tried to study but I couldn't get my study permit so we decided to ask for refugee using my country situation and all the violence we suffered there( wich is real but random crime happening to everyone every day)
I know all this, my only concern is knowing if there is a minimal possibility of asking for a bit of time.

The CBSA has minimal discretion to defer a removal, however they can make the removal arrangements such that they can accommodate a request for a good reason. The reason that you mentioned, baby-sitting an ill child won't get you anything, in my opinion, because what difference will 2 or 4 weeks make?

That you failed to appear for the earlier removal and required a warrant, haven't been to Uruguay for many years which has a democracy and freedom of movement (that's why a PRRA was done so quickly) are negatives for any officer.

If someone meets a CBSA Removal Officer and begins to express that they cannot return home, or that they fear a return (after negative CR and PRRA decisions) then what they're doing is providing the CBSA with grounds that they are unlikely to appear for their removal. That can be when handcuffs appear.

You are likely going to want to return to Canada one day so cooperating with the removal process is forward thinking. Trying to be crafty in order to buy time isn't new and isn't advisable because CBSA officers like arresting people and escorting them to far away locations.

Grasp the reality of your situation and make your plans for returning home so that you can lessen its impact when it inevitably arrives and you're in Uruguay once again.

Yes my stress is over the top.
If I leave the country when they told me,, do you think I can come back some day?
In my understanding I believe that wasn't possible.
Could you please tell me if they use our UCI number as case number for Humanitarian cases? My counselor told me that but I wasn't able to found my case on the government website. Also I never read the submission he said is lots of info that we don't understand.
My husband is doubting if he did the submission for us 2 years ago or not.
He told me Immigration some time ask for updates so you send anything new in order to make your case stronger.
He also said they will let you know every step, now he says they opened but no decision are being made yet. You can send more info.
Im wondering is this person is totally true to us. I feel like now is to late to do anything and we lost 2 years maybe waiting for nothing.

Yes, the UCI should be the same.

You should always try and keep the application up to date with important information.

I wouldn't know about that.

H&C cases are taking around 3 years but you should have received information by mail. Did you move after you CBSA contacted you the first time. Honestly as you previously admitted you didn’t have grounds for asylum and you only applied after you couldn’t get a study permit. I am a bit confused as to how you entered Canada since it seems like you were deported from the US or you at least you didn’t leave willingly. You are trying to immigrate to Canada but you didn’t qualify. With an adult daughter and another child who is a US citizen you don’t have any H&C grounds based on your children. I think you have to come to terms with the fact that you will not be able to remain in Canada longterm. You were very lucky to be able to stay this long but that was due to the influx of other asylum seekers. Unfortunately I am not as optimistic as @Bornlucky on your chances of being to travel back to Canada. If you are able to be sponsored PR then you can travel back to Canada but your chances of coming to Canada on a temporary visa are pretty low since you claimed asylum for in Canada and it seems as though you may have overstayed in the US as well. I would speak with CBSA and go from there.

No I wasn't deported from de USA I left because we couldn't do anything about legalization.
I entered Canada with a visitors visa and then I did all the above.
Anyway Im not looking to stay longer without status, I was just hoping for time to organize my return better and eventually if Im still lucky with can have an answer from H&C.

It does still sound like you overstayed a US visa so also doesn’t help. Knowing that leaving is likely you should be actively trying to get prepared to leave already.

Can you tell me how can I get information about my H&C over the phone? I saw some people called and get info. I know I'll need my case number, I'm trying to get that from my counselor.
Im actually worried she's being avoiding me and having excuses to do it.

Hi guys,

Here I am again. I went to my CBSA appointment the past January 19th. Obviously it was to start deportation process. We asked for permission to stay till the end of may when my work permit expires but they haven't given me the final date yet.
At the same time I found out my immigration consultant never filed my case 2 years ago. Whe I told her that she told me lots of excuses . I filed a complaint against her on Thursday and Friday I got from her my case file,.
Today Im going to see a lawyer, because she filed my case 2 days after I confronted her wich is crazy, I have more than 300 text from her for the past 2 years speaking about the case and she was lying all the time.
Im so sick I losted my voice due to all the stress she put me trough...now my only concern is to clarify this so she can't keep scamming families.
I will keep you posted, this might help someone to be more cautious.

Hi there,
I would like to update my situation. After my hearing with CBSA I confirmed my biggest fears, the consultant never filed my case she was lying to me for the past 21/2 years. That was devastating to my family, but we also have the chance to apply for real this time and use all this in our favor, a least that's what a lawyer said and the CBSA officer implied.
We present the letters asking for extra time and they were so reasonable, they call to give me time till the end of June allowing my daughter to finish school and considering my employer difficult situation, but I told them about the pregnancy( due date in July) because Im trying to do the right thing for our future application.
Conclusion, I filed a complaint against the consultant, hoping her license is revoked and she can't do this to other families.
Im building my new case and still waiting for the departure date wich it's happening anytime now.
I wanted to update this because it's crazy unbelievable, and to rise awareness for others, be very cautious, ask for your files, fees receipts and everything to be sure your case exist, don't be naive don't fully trust.
The best to all!. We are happy to go home and hoping for a positive response in 2 years!

What are the possibility on this UK police report.?
I applied H and C and got approved last year Mid AIP. Medical done,paid landing fee, finger prints done.

If you want you can try now to dial at their automatic call system, so that you can hear the status of your medical and etc.

1. It means that you have a record in the UK which has been stepped down. Possibly a caution, only you know. CIC will want the details.
