What was your lawyers opinions on the PRE-nups?
A friend of mine had a "PRE-nup" drawn up for him and his Cuban wife.
She left him, took him to court for 1/2 the house, pension and rrsp's.
she won. The judge said that because he was still under the undertaking to sponsorship that a prenup was null and void.
This is a couple years now, but he did have to give her 1/2 of everything, except the amount he paid toward the house before their cohabitation.
First of all....there is a chance with pre-nups because they are signed in Cuba that the spoouse could claim it was not explained to him/her properly and do that angle....language barrier...have seen this more than once. Pre-Nup has nothing to do with sponsorship approval....sponsorship pays the government money that the applicant may use......she would be allowed 1/2 of the increase of the fair market value of the house after marriage...that is standard.....and with respect to pensions & rrsp's usually it has to be a lengthy marriage to get that...at least 10 years....anything under that is usually not given or a small small percentage......so depending on the reason why the marriage failed could be the reason the judge allowed certain things....either that or one party had an extremely good lawyer and the other one had a sucky lawyer....it happens...
