Hello All,

So after all the sweating and sleepless nights looking at the number of appl in 3142 go up, I now have sme good news to share.

I got my IELTS results today and I scored
R:9, L:8.5, W:8 and S:7.5

Yohoo!! Phew!!

As I am still struggling with the personal history section of the form, I have a question.

The leave no gaps caveat scares me :( I do not want my application to be jeopardized because I missed something, or wrote something tat wasnt really needed.

Right enough of my ranting, can someone please help me with this?

I did some part time work during my college days as a fitness instructor but I do not a letter of experience from them and therefore do not want to show it in my personal history. As this time was during the course of my normal study course, can I choose not to mention it?

If I have to, how do I show it as I was attending college from 7-9 and working in the gym from 11-2 everyday for arnd 6 months.Secondly, the gym has now closed down *The woes!!*

Any suggestions please?

1) CIO Sydney – Completeness check
Once your application arrives at CIO, Sydney, Nova Scotia, Canada the first thing that happens is it will undergo a completeness check. This check will ensure:
– That you have included all required forms
– That any forms which have space for a signature have been signed and dated
– That you have not left any blank fields
– That you have included the correct payment fee
– That you have included all supporting documents required by both the main CIO checklist, and the visa-office specific checklist

If unsuccessful your entire application will be returned to you by regular post with a covering letter. You will not get an email notification from CIO.

2) CIO Sydney – Payment charged
If your completeness check is successful your payment will be taken. This means CIO will attempt to charge your credit card, or they will cash your banker’s draft, depending on which method of payment you chose.

I would personally strongly advise using a banker’s draft if possible. These are like personal cheques but they are guaranteed to clear so there can be no payment problems. Most banks will usually charge a small fee for issuing one of these.

Credit cards can be risky. Many banks and credit card issuers use automated security software and when the software sees the source from Canada it may block the transaction, which in turn could lead to your application failing and being returned.

If your payment is unsuccessful your entire application will be returned to you by regular post with a covering letter. You will not get an email notification from CIO.

3) CIO Sydney – Eligibility review
CIO then perform a complete eligibility review on your application, based on the information you have provided on your forms and they will examine your supporting documents to ensure it backs up the claims you have made.

Since as of 1st July 2012 there is no longer an in-demand list, they will need to see an AOE (Arranged Employment Opinion) or positive LMO (Labour Market Opinion) with a TWP and this must be for a job in Skill Levels 0 (Managerial) or A or B on the NOC list.

For both categories they will also assess your application against the selection criteria – age, education, work experience, adaptability, job offer and language skils etc, to ensure you have 67 points. They will use your supporting documents to convince themselves that there is sufficient proof to back up the claims you have made on your forms in these areas.

If your eligibility review is unsuccessful you will receive an email stating the reasons and your entire application will be returned to you. Since CIO have already taken payment by this point they will initiate a refund of your fees, which will likely take several months to get to you. Please note this is the last point at which you will receive a refund if your application is unsuccessful.

At this stage your ECAS status should now read “CIO eligibility review complete”.

UPDATE 18-Apr-2011: Please note that several people have been told that you do not get your application back AT ALL if your application is failed at the eligibility review stage, all you will receive is a refund for your processing fee.

UPDATE 29-Jun-2012: FSW1 frozen for 6 months, so at the moment you need a job offer.

4) CIO Sydney – PER issued and file transferred
If your eligibility review is successful, CIO will send you a confirmation of positive final eligiblity review. This will be by email if you specified an email on your application, otherwise they will send a letter by regular post. They will then transfer your file to the CHC/VO (Canadian High Commission/Visa Office) for further processing.

Please see the “PER” page of this blog for the text of the PER and also the CIC email address from which it will arrive, so you can add this into your contacts list on your email.

Once the file gets to the visa office (which usually takes 2 to 4 weeks) your ECAS status will read “Received by visa office”.

5) 2nd AOR from visa office

Once your application arrives at the visa office, they will sit on it for a while. When they are in a position to process it most visa offices will send you a 2nd AOR. Please see the link at the top for an example of this, from Manila office and the wordings vary from visa office to visa office. Also some offices send by email, and others send by snail mail. There is still no need to do anything at this stage. A few visa offices, most notably London, will not send a 2nd AOR at all but will skip this and go straight to medicals, or ask for further documentation.

6) Processing begins – document background checks

Once the visa office begins processing your file they will commence with document background checks.

At this stage your ECAS status should now read “In Process” with the extra line in the detail “Your application was reviewed and we started processing on <Date>”.

This document background check will include ascertaining the authenticity of your documents, and since they use some third party companies for this it could take a varying level of time depending on your visa office, the complexity of your case, and even the speed of the individual visa officer looking at your case. They may also perform employment verification checks which will involve telephoning both you (whilst at work) and your employer to ensure you give the same answers on their questions about your employment. Only a small percentage of applicants are likely to receive employment verification. Only if they are unconvinced by any of the work experience documents you sent, or if your application is one of the random spotchecks they do to prevent fraud, will they actually perform the verification.

Visa office may request further documentation from you during the processing phase, which can come by email or snail mail. They may also ask for a few things (PCCs or fresh forms) at the same time as medicals (see below)

7) Medical requests and RPRF fee request

Once the document background checks are completed satisfactorily, the visa office will write to you (usually by snail mail) requesting you to complete medicals and also requests RPRF (Right of Permanent Residents fee). They may also ask for updated documents such as PCCs and fresh forms at this stage. Please note that New Delhi visa office will also request passports at this stage. Most other visa offices will not request passports until they are about to finalise the application.

This will basically involve your booking medical appointments at one of the approved DMPs (Designated Medical Practicioner) throughout the country. The fee will vary slightly from DMP to DMP, but they are usually around CAD $450 per person, obviously converted into your own currency.

RPRF at this time (18-Apr-2011) is CAD $490 for the principal applicant and also for accompanying spouse. So PA + spouse in total is CAD $980.

Process of PR Application for FSW Applicants

Completeness Check

1. They received couriers and do a initial documentation check for completeness and compliance of the application.
2. Check if the applications forms are all completely filled, payments are ok, all required documentation are enclosed.
3. Check if we have valid 1 year experience in the claimed NOC(a part of the 29 occupations list)
4. Check the CAP has been reached for that NOC yet.
5. They accept the payments as submitted with application and that's the last stage of the completeness check.
6. If the application passes the completeness check, it's put in the queue for the Eligibility Review. If not they send the application
back stating the reason for return.

Eligibility Review

1. During the Eligibility Review, they check and award points for the following 6 selection factors

Education
Work Experience
Age
Language Proficiency
Adaptability
Arranged Employment

2. In addition to these 6 factors, they check for the proof of funds as per the guidelines. They also do the background check for the above at this point before awarding points( they confirm the job duties comply with requirements for that particular NOC and that experience documents are satisfactory.

Positive Final Determination of Eligibility for Processing

1.If the applicant gets 67 points or more, then his/her application will be transferred to the visa office identified by the applicant on the IMM 0008 form for a Final Selection Decision. CIO will send out an email confirming this which will indicate a Positive Final Determination of Eligibility for Processing. If the applicant fails Eligibility Review, again CIO sends and email out to confirm the reasons for the same, and that they are initiating a refund of the processing fee.

2. Once an applicant receives a Positive Final Determination of Eligibility for Processing from the CIO, applicant will be able to check the ECAS Status of their application. We can use the application number/UCI Number/Payment receipt number, all of which we can get form the email that CIO sends out, to check the ECAS status.

Final Selection Decision at VO

Determination of Eligibility through Verification

1. Once the file reaches the Visa Offices they are queued up for processing. Once the file move to the table, AOR might be sent out to confirm receipt of application at the VO and the Background checks and documentation checks are initiated for the application.

Interview Queue
The VO may render a decision that, upon review of the application and supporting documents, the applicant is not required to
attend a Personal Selection Interview.If a Personal Selection Interview is required, the application will be placed in queue to await
an interview date. Your interview will not schedule at this time.
An Interview Waiver
Within the correspondence of the interview waiver the VO may also request that further documentation be submitted. The
submission of PCC, updated forms, RPRF, Medical (In India PP request is also club with these docs).
Refusal of the application
Upon the initial review of the application, the immigration officer may decide that the documents submitted do not establish the
level of qualification required by Canadian Immigration. And may be during the background check Work experience or educational
documents was not verified.

Selection Interview

1. The VO is entitled to request that an applicant attend a Personal Selection Interview if he/she has concerns regarding any or all of
the following:

Authenticity of the documents submitted
Truthful and total completion of the forms
Verification of the information entered on the forms
Clarification of the specific information provided to Immigration Canada

Note: The VO will not conduct and Interviews to assess language ability.

Under the new regulations, selection standards are more objective and clearly defined. It is expected that in most cases visa officers will be able to make a decision to approve or refuse an application based on the documentation provided by the applicant without a election interview. However, in some cases, an interview may be necessary for a number of reasons. Especially, if you do not meet the pass mark in effect and are applying under “Substitute Evaluation”, you are more likely to be called in for an interview to decide if there are reasonable grounds to exercise positive discretion

Purpose of Interview

If required, a selection interview would be conducted for several reasons:
To verify the validity and truthfulness of certain information provided on the forms and documentation submitted with the
application.
To clarify any specific information and inconsistencies.
To clarify certain issues as regards to the background of the applicant and/or his/her dependents.
To verify that the applicant possesses the necessary funds to settle in Canada.
To confirm that the applicant is not inadmissible on security grounds.
To verify if there are sufficient grounds to use positive discretion, if the applicant's point total is below the current pass mark.
Under the new regulations, visa officers will no longer conduct interviews to assess an applicant's language proficiency or personal
suitability for immigration purposes.

Interview Waivers

At their discretion, visa officers may approve an application for permanent residence in Canada without holding a selection interview. An interview waiver will significantly expedite the processing of the application. Usually, well-prepared applications, which are complete in every detail will increase the chances of an interview waiver.

When assessing an application under the Skilled Worker category, visa officers will consider several factors before granting an interview waiver such as:

Quality and completeness of the application forms and documents

Proof of the applicant's English and/or French language ability

The applicant's educational qualifications

The applicant's professional qualifications such as quality of his/her educational background and work experience

The applicant's potential for adaptability, resourcefulness and motivation to successfully establish himself/herself in Canada

The applicant's overall integrity and credibility


Nevertheless, a selection interview may occasionally be required for even highly qualified applicants, as Citizenship and Immigration Canada (CIC) officials randomly select such applicants to test the accuracy of their interview-waiving criteria for quality assurance purposes.

Rarely, it is also possible that after an interview waiver has been granted, the visa officer may change his/her mind and require the applicant to come to the selection interview or vice versa.

Discretion of the Visa Officer

I. Positive Discretion

The visa officer can use his/her discretionary power to approve an application under the “Substitute Evaluation” provisions of the new regulations if the visa officer feels that the applicant is likely to become economically established in Canada or the applicant's point total is not a sufficient indicator of whether or not the applicant may become economically established in Canada.

II. Negative Discretion

Similarly, the new regulations also make it possible for the visa officer to refuse an application regardless of the applicant's point total where the visa officer is of the opinion that the applicant does not have the ability to economically establish himself/herself in Canada.

If the applicant pass the interview and got Positive selection decision from VO we can read following line on our ECAS

Upon completion of the interview, the applicant will be required to pass both the Medical and Security requirements. The immigration officer may also request that further documentation be submitted as had been requested at the interview. As a general and standard time A Permanent Resident Visa can be issued within 12 weeks, from the date of receipt of the last documents at the processing Post.

Medical Request

At this stage we receive Medical instruction + Add docs +PCC + RPRF(+ In India PP request as well). All applicants as well as all dependents (accompanying or not) will be required to pass the medical requirement. The Medical examination requirement is mandatory and serves the following purpose.

To protect the health of Canadian.
To protect the safety of Canadian.
To reduce and prevent excessive demand on Canada's health and social services.


Note: The medical report is valid for one year from the date of completion.


Security Clearance

Each applicant over the age of 18 is required to pass the security requirement. All applicants must prove that they are not a threat to the safety of Canadian Society. Applicants provide this information through Police Clearances which the applicant must obtain directly and by passing the background clearance which the immigration authorities obtain on behalf of the applicant.

After receiving Medical results by Regional Medical, they enter into GCMS 4.0 system, after that Otawa, Canada Check the medical results if they don't satisfy they email to applicant for further test, if they satisfy and approve the results they generate the following line of ECAS.

It means that your medical results approved and seconded by Ottawa, Canada, and you are 90% approved at this stage and your Passport request is on the way.

Final Approval from VO

The last stage of the application is the issuance of the Permanent Resident Visa.

Passport request:

Once the immigration authorities are ready to issue the Visa, applicant will be required to submit their original passport for Visa Stamping. Original Passport must be submitted for the Principal applicant as well as each accompanying family members. Each passport will need to be valid for at least 12 months and have minimum of 2 pages per visa.

Validity:

Each Permanent Resident Visa is valid for 1 year from the date of the Medical exam or until the expiration of the passport. The Validity of the PR visa from the date of medical exam refers to the first exam completed (either principal applicant or dependent). The principal applicant and each accompanying dependent must make their official landing in Canada before the PR visa expires. Failure to land before the expiration of your visa will void the visa and will then result in the necessity of a new application. The validity date of the Visa cannot be extended.

At this stage we can read the following Final change on your ECAS

I am the primary applicant FSW2014.I got my PER mail and my file will be transfered to Local VO New Delhi India.
Currently am on work permit in Indonesia and will continue to be here till April-2015.

Please let me know how can I intiate PCC ( Police Celerence Certificate ) in India from Jakarta , Indonesia.
I visited Indian Embassy in Jakarta , they said they can help me in getting pcc in Jakarta only.
I need to get PCC from India Hyderabad as well. My wife and kid are in India, Hyd.

Please help me on this.

Dears,

the experience letter that i have, is on paper which has the logo and name of my company. however, it has only the name of my manager, his email, his phone , his signature. and offecial stamp of a higher manager but this stamp is not in an english while the letter is in english.

additionally i will include a business card for my manager and bank statment which show salary transfer for two years.


the problem that there is not footer for the document which is contain organization details address, fax and web site. only small logo and name of the orgnization at the header


do you think this will be enough?

Dear All


I am eligible for FSW. I have worked for 3 years in a multinational bank. However, the firm only provides a standard employee reference letter. The letter does not disclose salary or the main duties undertaken by the employee. The firm does not make any exceptions.

Would that be sufficient for claiming points for work experience?

Normally, I do not talk to 'Strangers', as taught to me by my parents since an early age. However, I am making an exception today ;)

Option 1: CIC already has your original IELTS TRF. Therefore, you need not send it again with your second application as long as you earlier TRF is within two years of validity. This is as per CIC instructions. I believe "neel-here" did provide you this solution earlier. Just send a photocopy of your earlier TRF and point out that they already have original TRF in their records (You will have to refer to earlier refusal email from them)

Option 2: You need to persuade BC hard. As per rules, they do not issue second TRF to anyone, UNLESS it is for immigration purposes. Some search around their site and you should be able to find this rule. You need to point this out to them while persuading them for second TRF. I recall a successful attempt by one forumite to get second TRF from BC this way.
