@legalfalcon

Hey! Since you are legally inclined can I ask you a general question about NOC codes and their requirements.

I am seeking information regarding NOC 1111 - Financial Accountants and Auditors. (https://www23.statcan.gc.ca/imdb/p3VD.pl?Function=getVD&TVD=122372&CVD=122376&CPV=1111&CST=01012011&CLV=4&MLV=4)

If someone has a job that matches all job duties and has a university degree, but not a CA/CPA designation, are the eligible to apply under this NOC?
No other NOC matches them except this one.
When selecting the NOC, it does not matter whether you have the the designation or the education for it or not.

Minimum work experience requirement
The applicant must have accumulated at least one year of continuous full-time (or the equivalent in part-time) paid work experience in the occupation identified in their application for permanent residence as their primary occupation. In calculating this period of work experience, the occupation must be listed in skill type 0 (Managerial occupations), skill level A (Professional occupations) or skill level B (Technical occupations and skilled trades) of the National Occupational Classification (NOC) 2016 [R75(2)(a)].
The applicant’s skilled work experience must also
  • have occurred within the ten years preceding the date of their application for permanent residence; and
  • not be in an occupation that has been designated as a restricted occupation.
Note: At the time of publication, no occupations were designated as restricted.
In addition, during that period of employment, the applicant must have
  • performed the actions described in the lead statement for the occupation as set out in the occupational description of the NOC [R75(2)(b)]; and
  • performed a substantial number of the main duties, including all of the essential duties, of the occupation as set out in the occupational description of the NOC [R75(2)(c)].
Note: The applicant does not need to demonstrate that they meet the “employment requirements” listed in the NOC occupational description.
There is a post on this where I weighed in at https://www.canadavisa.com/canada-immigration-discussion-board/threads/noc-2173-software-engineer-education-relevance.587494/#post-7280034

I have a question regarding police record.

I came to Canada in September 2014 when I was already 18 at that time. I spent more than six months in my home country before I came to Canada after I turned 18.

I believe I would need a police record from my home country because of that.

Now, I had previously done one police record for a CRA job clearance in 2017. Can I use that one for my PR application as well? So the cut-off date would be in 2017 instead of now but since I came to Canada, I did not spend more than 6 months back in my home country. I would do a new one but because of the COVID-19, it is not as convenient to get a new one as before.

Thank you everyone!

I believe it only valid for 6 months. So you probably have to get a new one.

Apparently, the progress bar is back. It appeared when I checked my account this morning.
I received a request for IMM 5475 form, for which I am putting up soon.

How long does it take to get the progress bar after E-AOR?
I guess when they start touching the application (well, that was why they sent me the request for the additional document).
My AOR was on 01 Aug 2020, around more than 2 weeks ago.

All the best for your application!!
Hey @legalfalcon , can I ask you another question? I submitted a reference letter but it was not issued on letterhead. My supervisor who signed letter confirmed that they were not able to issue the letter on the letterhead because it is contrary to corporate policy. In my LoE, I explained the same and asked the immigration authority to refer to the company's official website and/or call them.

On their twitter account, IRCC once stated that "We can't comment as to whether this will be sufficient [...] You should upload a letter explaining the situation in detail and include whatever proof you may have (ie. job contracts, pay stubs, letters of reference you received from the employer that you used in applying for other jobs, etc.)."

Could this be a problem? Should I submit some extra docs now via the webform?

ITA: July 8
Upfront medicals completed: July 22
AOR: August 18
Country of residence: Canada
Country of citizenship: India
Category: FSW: Inland. I have heard this category is processed the slowest. :(

Good luck to everyone! A few questions / comments:
  • Been reading @legalfalcon's notes about RCMP pcc. If everyone inland is asked for this, I would like to get it done in advance and submit via webform. What I don't understand is whether fingerprints are always needed for a pcc. My local police services says they will process one without fingerprints if I have no adverse record that comes up on a name check. But if IRCC will later not consider it valid, then I would rather get one with fingerprints. IRCC website says you "must" give you fingerprints for a criminal record check. It's confusing.

  • How long after AOR does the progress bar show up, i.e., could it be weeks and weeks before they touch the file? Ugh!

  • With biometrics unavailable inside Canada, what do they do in that one month period of time after issuing a BIL? Do they ignore the application until those 30 days pass or do they keep working on other parts of the application in the meantime? I'm trying to understand if these steps take place in sequence, do they only do an IP1/IP2 if I submit my biometrics. Even if this was the case earlier, it does not make sense for them to do nothing for 30 days, keep extending the BIL deadline forever, and never work on any other part of my application until covid is over and biometrics collection resumes. Surely, this cannot be the case?
I hope everyone is keeping safe and sound. Take care, all!
