I am not sure why you guys aren't able to PM me, i have it turned on have spoke with some one on Pm. Anyways, there is no update right now, i am going back and forth with officer with concerns they have and trying to satisfy them that my full time presence is needed in Canada for this business to operate (which it does).

@canadavisaQs all the best for your Interview and did you request GCMS notes for your TV refusals ? I know it won't make any difference now but on a safer side if you request, you'll get to know the exact reason for refusal.

No, i really don't care. I mean, i know they have made a mistake here but its not worth my time to appeal. Sooner or later i will get PR and this will all be history.

My US B1 visa was denied in 2009 but in 2010 i got the standard 10 years visa. Sometimes they don't see it the way we think they should.

Sorry ... forgot to ask you this question : my lawyer who incorporated/ registered the company for me in Canada ( who’s different than the immigration lawyer ) , stated :
2- I’v paid the fees for the immigration lawyer already ( before applying / getting the work permit ), is this OK ?
yes, it is totally normal for consultants and law firms to charge before applying. They are not going to do all the work and hopefully get paid. They are charging you for applying not approval

@canadavisaQs Can you please shed some light on interview questions and concerns raised and from what you have mentioned it seems the officer is trying to prover otherwise (your full time presence may not required for your proposed business)

The business plan was written by a company that does this full time. I provided them a lot of information regarding my business and they turned it into a very nice presented business plan. If you need info of the firm, feel free to PM me and i will be happy to share.

I also did the corporation myself and thats fairly simple process.

i think thats somewhat true. Primary questions are around the fact why do you need to be in canada to run a business, specially if its something like an online portal, that can be done from anywhere in the world.

Don't think providing that info publicly is possible, pm me and i will share the name but if i had to do it all over again i wouldn't work with them. They are extremely slow, look at the time when i started this thread, been over 6 months i think.

I have gone ahead and completed the process of setting up the Corporation, Leasing Office Space & Opening A Bank Account. I have also created a business plan and I am submitting the application via an attorney based in Toronto.

Can someone clarify that if somene gets a successful owner operator work permit;

The questions are based on a hypothetical scenario wherein work permit is approved but during the first year itself enough points are still not manageable and wherein one has to avail more points using Canadian experience and education. Which may take around 2 years of living in Canada without a PR.

- Can he bring his family to Canada?
- Can the family avail free health care benefits?
- Can the children be avail lower fee structure at universities, similar to a permanent resident?
- Can he work elsewhere, part time?
- His family can apply for visas to join him but approval is not guaranteed.
- Yes.
- Yes.
- No.
Just want to correct that on a work permit the children would need a study permit and would pay international fees to attend college/university. College/university age children will either have provincial coverage or international student health plan depending on the province if studying full-time and having a study permit.

Update Update Update

After all these negative updates and getting rejected twice for TRV, today i finally got positive LMIA from service canada. This has not been easy and there has been a lot that i had to do during the last 2 months, but its hopefully all worth it.

Keep in mind, i only got approved for NOC 0125 which fetch only 50 points for Permanent residency application, even though i applied for NOC 0013
Further, the officer reduced the term to 1 year for work permit instead of applied 2 years.

all in all, i am happy and now applying for work permit. It says 5 weeks processing time, hopefully we get the work permit for family by end of march or beginning of april.

I feel like an expert on owner operator LMIA applications, since i had to do multiple calls, emails and other communications with the officer during these last 45 days.
