This is Snehal Mahajan-Khindare. My husband holds a work permit(LMIA approved) for two years.His job is under NOC. I want to join him there in canada as his dependent spouse and want to work too. I am currently in India. I dont have children.

I hope you meant to say under NOC O, A or B.

Is there any need to fill up the form of temporary resident visa IMM 5257 with the work permit form IMM1295..?

Yes, it will help you in future when you will file for PR.

Please suggest me an additional information about the actual process and the documents required from my side and husband's side.

Is it mandatory for my husband to gain a year of experience of canada to sponsor me..? Not at all mandatory.

I am giving some details of the documents and forms that I have discovered and I have started to gather.Please suggest me whether to attach them or not.



1. Main application IMM 1295(Open work permit)
2.Family information form
3. My passport scan copy
4.Husband's visa grant letter ,Work permit letter and scanned copy of work permit stamp on passport.
5. Strong cover letter explaining the need to live together. just go easy here, dont get too deep otherwise cic will get suspicious. it is obvious that husband and wife will live together.
6.Marriage certificate
7.Marriage invitation card
8.20 photographs for proving the genuine relationship. 40-60 pictures, 30-40 marriage pictures, approx 20 post marriage pictures, if you went on a trip after marriage, those pictures too. if you have any hotels bills, bus/flight/train tickets for that trip those will also help. any bills you can produce for that trip, you should.
9.Husband's offer letter and appoinment letter ; your husband's job reference letter clearly mentioning his job designation and roles and responsibilities and NOC code mentioned on it with the employer's stamp and signed by HR on company letterhead.
10. Cover letter from husband for sponsoring me.
11.Payment proofs. I believe you mean proof of funds. yes.
12.Husband's current residing place proof. yes.
13. Bank statements.(Mine), if your husband is working under NOC O,A or B. theres no need. But if you want to show you can. Its just a positive thing if you can show.
14.Educational certificates and marksheets(Mine). yes.
15.Resume and Experience letters(Mine), no need of resume here. just experience letters and job reference letter for you. same as defined for your husband.
16.A cover letter assuring to leave canada at the end of my stay. would not recommend. you will be given a visa with the expiration date of as your husband's visa. cover letter requesting to live together is enough.

For proof of communication, make sure you submit the call records, whatsapp, regular and chat/text history, any email communication. for last 6 months atleast to 1 year.
And your husband's passport copy, dont forget. all the best!

Hi! I have an open work permit acquired as a dependent of a temporary worker here in canada. my husband's employer submitted an application of extension of our work permit. now, i also want to study. can i apply for study permit while our work permit extension application is ongoing?
what is your or your spouse NOC code? if it is under NOC O,A or B, you should have filed for provincial nomination by now if you have been living here over 1 year and also file for PR if living over 1 year 6 months. you can file for study permit for sure. approval depends on relative selection of course and your previous academic credentials.

I have applied for SOWP online.I got request for passport but didn’t received the same for my child. My child medical showing passed but no request further.
We both were already having visitor visa.
Please guide what to do

As you both are having visitor visa, you are here in canada or in other country? and also, what is your spouse's NOC job code? Does your online application say that your application has been approved or you just received a passport request?

Hi

I am on a H1B in the USA and my employer would be processing my Work Permit in the Intra Company Transfer to Canada. However my company mentioned they no longer process the OWP for Spouse. They would process only Visitor Visa. my NOC is classified in A category per my Work Permit. What would be your recommendation, once my Spouse Visitor Visa is stamped, then I need to process the SOWP from USA and how would I need to do that and how long is the approx processing time.

Or I need to travel and reach Canada and then process the SOWP what is the processing time for that?

Any inputs based on experience is very much appreciated.

my recommendation, once you both reach canada, after that go for sowp, go for visitor visa for your spouse first.
Although, the processing time for work permit applied from US and canada is almost the same, but just in case the file gets stuck for your spouse in the US, you will either have to withdraw the application as it will be getting processed in US and you would need to come to canada or leave your spouse behind untill the file is processed completely.

As you both are having visitor visa, you are here in canada or in other country? and also, what is your spouse's NOC job code? Does your online application say that your application has been approved or you just received a passport request?
We are in India.we were already having visitor visa up to expiry of our passports.
My online application says approved.
But not in my child application.
I am confused for the status of my child application.

I looked at the checklist (IMM5556E) and the following documents are needed:
  • IMM5710: I select the option for an "initial work permit/new employer". My current work permit is a post-grad WP and as I'm a contractor, I plan to continue doing my contracting work after this is granted. I hope that's the right option
  • Photocopies of passport, current WP, marriage licence. Maybe I'll throw in a photocopy of my proof of contract agreement from my client.
1) Since the checklist doesn't mention the specifics for SOWP, are these documents enough or am I missing something?

2) I submitted my PR application back in October and am planning to submit the paper OWP application to the Alberta office in Vegreville. There's been some unseen circumstances and I want to be able to leave the country before my PGWP expires in July 2018, right now I don't want to risk leaving the country when my visa expires in less than 6 months. Is this the right way to do it?

can you please guid me how to apply for a minor child application along with the SOWP application? what kind of application & what documents? i am in canada on study visa & my husband in india wants to apply for sowp. Kid is 6 year old, if we apply for kid's student visa do we need to show funds? is schooling free in primary school? do we need an acceptance letter from school?

Hi Gaurav,

I really appreciate your time in answer my questions.

Context:

I have the SOWP that will expire in the end of this month, my wife got her PGWP valid for 3 years. Her actual job situation is a job with NOC B starting this week, so no payslips. Currently I'm working with NOC 0 in Ontario, but for a company based in QC. So I don't think I fit for the nominee provincial program of Ontario.

Questions:
- Can I apply using only her job description letter? I won't have any payslips at time.
- There's any other docs that I could send besides the Job description letter?
- I'm thinking to apply by paper and in the meantime working in my PR application, right now my score is 441 but I still need to validate my diploma.
- Any ideas?

My husband's noc category is unfortunately C so can I still apply open work permit.? Cause it is clearly mentioned that sowp is eligible for the spouses of noc 0,A,B. So should I go with that option or leave it..?

I have some questions. Want to apply for SOWP. I am in india and my husband is in canada on pgwp and working under noc b levele job
He is having joining offer letter with all job duties wages and weekly hours mentioned on it. But on joining letter noc b is not mentioned only his position n duties, working hours and wages are mentioned- is that enough? And the date on the joining letter is aug 2017 now do he needs new letter from employer with new date?? He is also having recent payslips.
One more thing - to prove he is a regular full time worker how much hours are required?? 35 to 40 or 40/week only?

Hi, I'm in a similar situation. I am reading on several forums that visitor visa can get rejected since it is given for 6 months whereas the spouse is trying to stay in Canada for more than 6 months. Do you think it's better to apply for sowp from home country instead?
