Hello all,

I'm a Canadian citizen's wife, we got married in 2020. We applied under the Inland Spousal Sponsorship programme in March 2021 and have recieved the email from IRCC that they have received the application. I am currently on implied status since my work permit expired last year and I sent a request for extension along with my PR application. Both my husband and I are to travel to India in November for my sister's wedding.

I'm looking for advice on the following:
1) Since I do not have a valid proof, can I apply for TRV from India so I can re-enter?
2) I'm fully vaccinated, does that exempt me from travel restrictions and reduce my TRV processing time?
3) What is the current processing time for TRV from within India?

1. You can reapply but you have to show that you are only visiting Canada with strong ties to India. Given you have an inland application under process, chances are high it will be refused. Also if you are outside country for too long, application may have issues because you are no longer inland.
2. Fully vacinnated doesn’t reduce processing times. You are exempted from travel restrictions.

If you do not have a valid TRV, I would advice against leaving Canada. If you do not get the TRV to travel back or get refusal on the TRV, you whole inland application will be refused.

Any implied status will be gone once you leave the country.
 
The immigration agent I am now working with strongly recommends staying inside Canada for the duration of the application even if you have a valid visitor visa. He recently had a client with a valid visitor visa and had an inland spousal sponsorship in progress. The couple decided to go back to Thailand for a wedding ceremony in front of her family. When they both traveled back to Canada, she was refused entry by the immigration agent. Subsequently, the inland spousal sponsorship was cancelled and they had to start the sponsorship over with an outland spousal sponsorship. Don't forget, even if you have a valid visitor visa, you are still at the mercy of the immigration agent when you arrive in Canada and they can deny you entry.
