Application for Permanent Residence from within Canada – Spouse or Common-law Partner in Canada class (IMM 5289)
If she applies for an Open Work Permit along with her PR application, she can stay as a "worker" until they approve or deny an INLAND application (Stage 1 or 2). If you apply before her student visa expires, she will have "Implied Status" until she gets the work permit. (She cannot work before she gets the permit though!) Also, if she's eligible, she can apply for a post graduate work permit. Depending on the length of her course, that may work out better. You should consider both options and decide what works best for you. Inland isn't recommended to leave Canada for any reason.

Outland can apply anywhere in the world, including inside Canada. Outland only means the Visa Office is outside Canada. She can try to stay as a visitor or on a post graduate work permit if eligible.

I would look at the time for her Outland Visa Office (VO), how much time she would get on a PGWP, and consider which country she is from too. It's a lot easier for visa exempt to stay as visitors during the Outland PR process. If you let us know this information, we can help break it down for you, although the PGWP is another category, so we might not be as helpful there! :)

If you apply Inland she can also apply to extend her student visa (it's another option besides an open work permit) and she will be covered by implied status as well - and in that case she can continue studying (it's the same class of application).

If you apply outland, she can ask to extend her student visa or apply for visitor status while the PR application is in process.

Inland requires that she be living with you in Canada. Outland allows her to live anywhere - even in Canada.

Under 25, not married, and a student (Even if they do NOT live at home) they will/can claim her.

I am sponsoring my common-law "in-land sponsorship" and about to submit our application soon.

She wants to be able to work asap right after Stage 1 (Approval). I forgot if it is the "open work permit" she needs to send with that or what's that form called again?

Can someone please respond and send a link to the exact form? Thanks so much kindly.

Write "Open Work Permit - Please Process when AIP is granted" on the top. This is a generic form so write "N/A" anywhere that doesn't apply.

You did keep a copy of everything AND send it via a courier, right?

If not, you should receive an Acknowledgment of Receipt for an inland application. Outland applications only get a sponsor approval normally.

Yes copies of everything, but no we only sent it through Canada Post. I don't believe we should have issues. I just thought there might be some sort of email or something.

Almost everyone got AOR from Mississauga for January 2013. The only person that didn't is fandv and his case was.... er.... special. (CIC misplaced his file...not trying to scare you or anything.) We were getting Sponsor Approval shortly after, sometimes in a matter of days. I haven't kept up with the trends since January, but AOR seemed a fairly routine process.
