What is her country of birth?

I am a US citizen waiting for my application to be processed since Sept 2014. I came to Ottawa Nov. 2014, went back to NY to visit 12 days and came back. I have been here as a visitor ever since.

She can stay here as a visitor as long as she keeps her status up to date. If the application takes longer to process than the time she can legally stay as a visitor you will have to file for an extension to her visitor status. Since I don't know what country she is from I can't go more into detail but that is pretty much the idea.

Sorry to quote you here. You are waiting since sept 2014? any issues with your application? so it is taking a lot of time to process US citizens? I am US citizen, my wife is CAnadian and we are sending the paperwork today or tomorrow, so per your timeline, I am expencting to hear from CIC in 8 to 9 months?

oh the small photos, it must be the principal applicant and other applicants...like you as the wife andf if you have kids...all applying must have photos. they will paste your photos in your PR papers....

Sry i forgot to mention, my wife as my sponsor is in canada. What i meant she as sponsor must stay in canada during the whole process of sponsorship?

The Sponsor does not have to be living in Canada if they are a citizen but they must show intent to resettle in Canada if they aren't living in Canada currently. If she just wants to visit you in your country while you guys wait it shouldn't be an issue.

Decided to go with the inland option..since i got married and my wife already has her visa for 10 years to enter Canada..should she change her last name prior to applying?

If she wants all her PR papers in her married name then yes. I didn't change mine and now I have to wait to get PR to change everything to my married name. It sucks. Might as well do it now. All she needs to change right away is her passport.

Thanks for the reply, she is not citizen only have PR which i believe the rules of citizen doesn't apply for permanent residents.

I hope someone else chimes in but I believe that Permanent Residents sponsoring someone must reside in Canada.

yes they do ..only Canadian citizens can reside outside of Canada and apply for sponsorship for there spouse.

hello everyone . i Am going to file my husband's case in this month . i have a question that after i submit the file and when file is transfered to new delhi is it necessary for me to saty in canada while they are processing the file? If there is a time limit after which i have to be back in canada? as i am plaanig to live in india with my husband till he gets visa.
is it true that i have to stay in canada for atleast 6 months in a year ?

Perfect..decided with the inland option, my wife called the Canadian embassy in Vienna they told us once her new Serbian passport comes in with her new last name she does not need to re apply for visa only to pay a fee to change the last name on the visa.

Since you are not a Canadian citizen, you must stay in Canada while you sponsor your husband. You can probably take short trips to visit him (a couple of weeks), but anything more than that could be a problem.

To answer your second question: No. Since you are a PR, you need to spend 730 days (2 years) out of 5 years in Canada to maintain your PR residency obligation, but you can't do that until after your husband has his PR.

We have the same situation, my wife as sponsor is in canada and already started the process, i am wondering what is the time limit that she can spend out of canada while sponsorship application is in progress.
