Hi,

I am going thru this forum for quite some time and found to be great source for a right advise.

I also have little similar case like many other here.

We do not meet the RO and our PR cards are already expired.
When we came here we did not have any issue at airport.

I have a daughter who is born outside Canada. So she could not join us as she did not have any visa. Her TRV was rejected thrice.

So now when we are here accumulating 730 days for renewal of PR cards, we applied for my daughter's sponsorship as TRV was rejected.

Latest status is that PR application for my daughter has already been moved to Delhi after clearing from Mississugua and we are just waiting for her VISA which as per CIC website takes 13 months in Delhi.

Now I am thinking of applying for my daughter's TRV again as now I have a hope that it may get approved as her PR application is in process.

am I taking the right step? or should simply wait until she get PR? btw, my daughter is just 4 years and staying with in laws.

appreciate your advise here.

You can try, there is no harm. If she was refused before however then chances are she will be refused again.

Two simple questions... 1) Did you meet the residency obligation requirements on the day that you submitted the PR application for your child? 2) Do you now meet the residency obligation requirements?

Answer to both the question is NO.

We still do not meet RO and our PR card is already expired. Still we have a hope that things will be fine as Mississauga have already completed the evaluation and file has been moved to Delhi since 6 months now. If they want to raise any issue, then they would have already raised by now perhaps.

Intention of applying for one more TRV is bring my daughter here early (if she gets VISA) rather than waiting more.

Unfortunately, Mississauga only does a very basic go/nogo evaluation of the sponsorship application. (Is the application complete? Is the sponsor on welfare? etc...) Your real examination starts at the New Delhi office. I wish you all the luck in the world. You are probably going to need it.

Having PR in process does absolutely nothing in terms of getting a TRV approved. So if she was rejected already 3 times, most likely she would just be rejected again. But there is no harm in trying if you don't mind filling out the application and paying fees.

You weren't reported at the airport for not meeting RO. The officer there gave you a 'pass'. You sent in an application to sponsor your daughter and just served up your entire family on a silver platter to CIC that none of you meet the RO. You should likely be prepared to receive a negative decision for the sponsorship of your daughter and you likely will also now receive an opportunity to 'fight' to keep your PR status.

When you got here and got the pass from CBSA by not being reported you should've stayed quietly until you met the RO before trying to sponsor your child. Now I am afraid you have opened up a whole new can of worms.
