Hi,

I have been freelancing on part time basis for about 3 years before graduating (Bsc), can i still get points for this? If so what should i do to prove my experience ?

Depends - if you were studying in Canada, no. If you were studying elsewhere, maybe.

Freelancing remote work experience can count if you can furnish documentation from the guys you were freelancing for. A special note to keep in mind here is that any experience accrued during studying does not count if it was in Canada.

I'm currently working in Canada and when my current visa expires I have an option to continue working for this company remotely. If I do that, can I claim remote work as a Canadian experience?

To be clear, you will leave Canada when your current permit expires, and work remotely from XX country for a Canadian company? No, you cannot use that as Canadian work experience, you (and your employer) have to be physically located in Canada...

But it would count as foreign work experience.

The thing is that after my work permit expires I need less than two months of Canadian work experience to get some extra points for 2 years of experience. I can stay in Canada as visitor for 3 (or 6?) months and work "remotely" for my current company, but I guess this still would count as a foreign experience, right?

Well, that would actually qualify as illegal : ) That is, if the employer is in Canada.

For it to be considered Canadian work experience, you have to be authorized to work (this usually means you have to have work permit).

So, is your employer not willing to apply for an LMIA for you?

My employer was willing to apply for an LMIA or help with PNP, but due to some circumstances his application will be refused (he already discussed that with a lawyer). So now I'm looking for the way to extend my legal work permit for those 2 months.

There's something called as Implied status which, as far as I understand, lets me continue working under the same conditions after my work permit expires while the government is processing my work permit extension application. Maybe just before my work permit expires I could apply for some new permit (even if it's clear that I'll be refused) and then try to buy some time by submitting all the documents very last day, etc. In other words - keep feeding the government with some bullshit for two months and then eventually cancel application when I have 2 years Canadian work experience.
Does anyone have any experience on that?

Btw, I already had Working Holiday and Young Professionals visas and can't apply for them again.

Should have mentioned this earlier, I hate to be the bearer of more bad news - "freelancing" (AKA self-employment" does not count for Canadian work experience... (foreign work experience can include self-employment, though).

Some people do manage to float an extra 2 months or so on implied status, some get refused before they reach their goal.... But if you're self-employed, it won't help ...

My friend submitted Ontario PNP app under Master stream in the first week of April. She hasn't got any AOR yet, do you know how master stream apps get processed? How much time they take ?
Should we create her EE profile also ?

She got one year work permit as her master degree was one year duration, she has about 6 months left on PGWP. What if they don't procesed her app in next six months ?

How long does paper master stream PNP takes ?

No, I do not, and the only info that Ontario Immigration has provided is that it is taking longer than usual.

The Masters Graduates stream is not an EE stream. She can create a profile (if she is found eligible), but if she gets the PNP nomination, she won't be able to use it for the extra 600 points. She will have to submit an application to IRCC on paper.

How long does paper master stream PNP takes ?

I do not know how long it will take for Ontario to process the PNP application. If she is successful, once she gets the nomination, she will have to submit her paper application to IRCC, processing times are estimated at 15 months. She would not be eligible for a BOWP until she submits her federal application and receives the AOR from IRCC. She may not be able to accomplish this before her PGWP expires - if the PGWP expires before she gets the AOR, she would not be eligible for the BOWP.

She can still apply, but she should be prepared to leave Canada while the application is processed. Alternatively, she has 6 months to find a job with an employer who will apply for an LMIA. That solves 2 problems - getting a new work permit, and having a high enough score to get an ITA under express entry (if she has the required work experience).

She can go on a visitor visa but not work. To be eligible for the BOWP you have to have valid (non-expired) work permit, so once she goes on a visitor visa, she will no longer be eligible for a BOWP. And 15 months is a long time to be a "visitor" -

Well, she could, as long as she is really studying - you can't just "go on a study permit," the rules have tightened up a bit -

There is no requirement to remain in Canada while a PR application is in process. There IS a requirement to either maintain valid status, or leave.

So there's nothing stopping her from going to the US, but you haven't said anything that suggests she would be eligible to get a new work permit to come back.

One more point - if you meant "can she go to the US, and apply for a BOWP (if she is lucky enough to get the AOR in time)," the answer is NO. There IS a requirement for the BOWP that the applicant be "in Canada" to be eligible.

Thanks jes_ON for explaining it in great detail. That really cleared up many of my doubts.

One last question.

My friend has precisely 7 months left on PGWP from tomorrow, if she gets her Nomination in October, which seems most likely from current scenario, she would still have 2 months before WP expiry to apply for PR. And if we apply the next day of getting nomination, are two months enough for Paper application to pass initial review so that we could apply BOWP on that basis?
