Hi Experts

I just got this letter from CIO-Sydney today (truncated the unnecessary details):

I have now completed the assessment of your application for a permanent resident visa as a member of the Canadian Experience Class and have determined that you do not meet the requirements for immigration to Canada.

I am not satisfied that you meet the skilled work experience requirement(s) because After taking into consideration the work experience supporting documentation on file, I am not satisfied that you have performed the actions described in the lead statement for the occupation or that you performed a substantial number of the main duties of NOC 2174 (Computer programmers and interactive media developers). The employment documentation on file from XYZ Canada does not indicate the main duties of your work experience.

Now my company doesn't issue any experience letter indicating the main duties of work expereince. What is issues is this:

This will confirm that you have been employed by XYZ Canada Ltd. since September 03, 2012
as a temporary employee. Your current position is I/T SPECIALIST in our ABC location.
Your estimated annual income is $1234.

But I do have the application package submitted to the Consular Office which clearly lays out that I will be working as a .NET developer with NOC code 2174.

There are other colleagues who have received PR with the same experience letter and application package combination. Now one of them suggested I haven't included a specific cover letter. Is that the only thing I am missing here?

Can someone please suggest how to appeal for and re-open my case?

Hi Leo, in your cover letter you can explain why your company is not willing to give job duties. It also helps to write your own job descriptions and get your supervisor or manager to sign off. I've seen other people do that in the forum.

Other than that, I can't think of anything else we can do. Maybe you can try talking to HR again and convincing them the importance of job duties?

Hi Zhang

My job duties and responsibilities are there in the offer letter and also in the Work Permit application package. Do I need to again mention those in the experience certificate?

That's the procedure post November 9th as indicated in the operational bulletin, as well as what happened with all of the in-process pilot applicants.

Yes, I'm aware of that, but the OP applied end of September :) So his application should fall under the 'old' rules.

Let's hope they're trying to implement the new rules with applicants before as well. Too late for me though :)

Hi Leo, it's probably easier to just re-apply. The officer usually looks at the offer letter. Maybe if you share the duties on the offer letter then we can assist better. My first application was rejected and the notes stated that they actually looked at the offer/contract. It would be weird if they skip it simply it is not on your employment letter.

Yes Tob very interesting!!

My lawyer actually told me that this is in depth at CIO, prior to pass onto CPO

Leo, you can try with an email, but an appeal with probably not get very far. It's only been a couple of months since you sent your application. There are plenty of applicants on this forum who have had to wait a year to be rejected, and then applied again. So you're in a much better situation. Your application will definitely be processed under the 12000 cap, so you shouldn't even worry about it.

Absolutely! I applied beginning of September, and haven't since heard from CIC. Maybe I'll try and get GCMS notes to
see if they apply those rules to applications before Nov 9th.

did you got the rejection letter from CIO or CPP-OTTAWA?please double check the rejection email and share.

The job duties are an essentail element of the Letter of Employment. Did you include a letter of explanation for not being able to provide all the required information? And provide proof (e.g. email indicating your company will not provide the letter.

A cover letter is not required per se, but if you omit a required document from the application, a written explanation is required.

You can try to appeal by sending an email, with either the required documentation, or the explanation, but the VO is not required to accept it. The burden has always been on the applicant to submit a complete and accurate application the first time, that is all the VO is required to evaluate. But sometimes, you can get lucky.

Yes, this is an interesting..same thing one my friend told.. his some friends got application returned back in just 2 months after receiving AOR, which means I think some junior officer looks file on CPP-O once it is sent by CIO- Sydney
