A friend got rejected for PR because the officer was not satisfied with his reference letter matching the NOC code he chose (NOC 1215). The letter was written by the HR with the Area Manager's edits. BTW the AM does not directly supervise him, so he felt he overstated his duties. He met an immigration officer who advised him not to reapply as his application may come under major scrutiny this time around.

He thinks he can get a better letter from his direct supervisor that will more likely align with his NOC code but here are the concerns:

1) Would CIC be concerned that the letter is signed by a different person this time around?
2) NOC 1215 includes supervisory positions. Will CIC wonder why it is being signed by a supervisor which the could consider as a colleague?
3) Can he reapply with a LoE stating why the initial letter was unsatisfactory? Will this raise misrepresentation issue?
4) The previous letter had his job title as 'Warehouse Worker.' Can he use the new title as 'Operations Specialist?"
5) He plans to extend his PGWP for the remaining 3 months CIC owes him. Can he flagpole for that?

I would appreciate any advise. Thanks!

No. The responsibilities should match the responsibilities listed under the NOC, irrespective of who issues the letter. In your case, I suspect the majority of the responsibilities might not have matched the ones on the NOC. While there is no hard and fast rule, ensure that at least 70-75% of the responsibilities match the ones listed on the NOC.

2) NOC 1215 includes supervisory positions. Will CIC wonder why it is being signed by a supervisor which the could consider as a colleague?

As long as it is signed by a 'competent authority', I believe it should be good. I would strongly recommend to get the letter notarized if the it is not on the letterhead.

3) Can he reapply with a LoE stating why the initial letter was unsatisfactory? Will this raise misrepresentation issue?

Nope, I wouldn't do that. Just reapply - you don't have to talk about your previous rejection in a LOE. However, he has to disclose this refusal in the statutory questions section of the eAPR.

4) The previous letter had his job title as 'Warehouse Worker.' Can he use the new title as 'Operations Specialist?"

He should have the means to back that up in case the officer wants to dig deep. The title really doesn't matter as much as the roles AFAIK. What matters are the responsibilities on the letter that match the responsibilities under the NOC.

5) He plans to extend his PGWP for the remaining 3 months CIC owes him. Can he flagpole for that?

I'm not sure about this one, I'll let others answer this one.

I would appreciate any advise. Thanks!

Thank you so much Raj. I really appreciate your response.

Regarding point 5, he tried flagpoling on Sunday but the border officer said he couldn't give him the extension but he should go online and apply for it.

Hi,
My application got "cancelled as incomplete". I chose Quebec as Province I intended to stay in my application. But I actually didn't have any plan and selected Quebec randomly. I have filled Web Form, requesting them to reopen my application as it is a mistake. Is there any chance for the application to get reopened?

Just wanted to let everybody know that I finally got my PPR approval and passport request.
I almost got rejected because of NOC duties (saw it in my GCMS and posted about it in January) and with some of your suggestions I submitted new letters and some further detailed info, and it has definitely worked.
Hello Connie and everyone,

I need your input in submitting an updated reference letter. I got refused due to job duties not sufficient and i choose the wrong NOC in my application. Now i know the right NOC to apply to and just need clarifications on updating reference letter.

1. Is there any harm in updating my reference letter ( getting a new letter from employer) by adding 4 -5 more duties to previous later and this will match the new NOC i would be reapplying under ?

2. In the letter of explanation would i need to say anything regarding me choosing the wrong NOC and getting an updated letter ?

Thanks ,

Why did you submit application without a reference letter?

Of course, you should get the reference letters in the prescribed format, and submit a new application:

Document requirements
  • The personalized document checklist in applicants’ online account prompts the applicant with an upload field for each work experience declared.
  • At the completeness check, the processing office determines only whether the required documents are included. The validity or fraudulence of the information is assessed only if and when the application is placed into processing.
The following documents are mandatory for each work experience declared:

  • a reference or experience letter from the employer, which
    • should be an official document printed on company letterhead (must include the applicant’s name, the company’s contact information [address, telephone number and email address], and the name, title and signature of the immediate supervisor or personnel officer at the company),
    • should indicate all positions held while employed at the company and must include the following details: job title, duties and responsibilities, job status (if current job), dates worked for the company, number of work hours per week and annual salary plus benefits; and
  • if the applicant is self-employed, articles of incorporation or other evidence of business ownership, evidence of self-employment income and documentation from third-party individuals indicating the service provided along with payment details (self-declared main duties or affidavits are not acceptable proof of self-employed work experience)

My Application got rejected due to Canadian employment do not indicate that you performed actions consistent with the lead statement. What should i do now?, I can get the new letter from my employer. Can i upload it via IRCC?
Please suggest, What would be the best option whether to submit the new EE profile or submit the new employment letter via IRCC?
Thanks

The onus is on you to provide all the relevant documents. Send the updated / relevant documents ASAP by using web form: http://www.cic.gc.ca/english/contacts/web-form.asp

If they have refused you then the best option is to create a new profile, be in the pool, get an invitation and submit another complete application.
