Question about past SDS study permit timeline and future Express Entry / CEC application
Hi everyone,
I would like to ask for some advice regarding a past study permit application and how I should disclose the timeline in a future Express Entry / CEC PR application.
In November 2023, I was working in South Korea. I left South Korea and returned to my home country on November 20, 2023. My home country was eligible for the Student Direct Stream (SDS) at that time. When I returned, my intention was to end my employment in South Korea and stay in my home country while preparing to study in Canada.
On November 30, 2023, while I was physically in my home country, I submitted my Canadian study permit application through SDS. After submitting the application, my circumstances changed and I returned to South Korea on December 4, 2023 to continue working for the same employer. My study permit was approved on December 13, 2023.
I am now thinking ahead about a future Express Entry / CEC application. I do not plan to claim any CRS points or eligibility based on this South Korean work experience. It would only be disclosed in my personal history, address history, and travel history for completeness.
My questions are:
1. In a future eAPR, should I proactively include a Letter of Explanation about this November/December 2023 timeline?
2. Could the fact that I returned to South Korea a few days after submitting an SDS application create a misrepresentation concern, even though I was physically in my home country when I submitted it?
3. How should I properly present this in address history, travel history, and personal history so that there are no unexplained gaps or inconsistencies?
4. Would it be better to consult an RCIC or immigration lawyer before submitting the PR application?
I want to make sure everything is disclosed truthfully and consistently. I am not trying to claim points for the South Korean employment; I just want to avoid any issue with past and future records not being clear.
Thank you for any advice or similar experiences.
