Today i got my e-mail reply by buffalo that my medical reached in buffalo and it's in process but they can not tell when the precess will complete .Little relief...


i doctor sent medicals on 15th july and received by ottawa on 16th july .


Hope for good news soon for july applicant...

I have applied for Canadian Visa couple of times. Once, when I was in school. I had to sent my I-20 for VISA. Second, time, visa was based on H1B. I used to work in San Francisco. Many Years back, one Friday morning I drove to LA consulate to get Canadian Visa in person as I had a trip lined up following week. LA consulate do not give VISA in person on Fridays. They collect the documents and ask the candidate to come back next week or give the option of sending passport by mail. I drove 6-7 hours from San Francisco and had to go to Canada next Thursday. I told the consulate exactly this. The lady at window looked at my documents, which had an employer letter, I-759 and passport with H1B Visa stamped. She talked to her senior and they decided to give me visa. I had passport back in couple of hours. Even the guard at door said that he had never seen something like that. What I am trying to say is that LA consulate folks are very considerate. Below are few options, in my opinion,

1) Go go LA consulate with your current I-759 and proof that extension is in process.
2) Get an I-20 from school ASAP.
3) Sit back and relax and improve your skills if you expect to receive your PR within couple of months. As long as you leave country within six months from Sept 30, and stay out of trouble, you will not get 3 year of 10 year ban to enter USA. As per rules, legal presence starts from day of expiry of I-94. If you stay over 6 months, you get 3 year ban. And if you stat over a year, you get 10 year ban.
4) put your belongings in storage. Go to India and wait of PR. You will get PR, unless there is a serious medical condition, which I am sure is not the case. So Cheer UP.
Believe, me, after staying 10 years in US on Student Visa and then H1B visa, stress is not worth it. Keep optimist and Alberta is a very good state to settle sown, both economically and naturally. I have seen Alberta developing from my first visit in 2001.

I still had like 22 months on H1b.

I guess i will give this final $300 to Uncle Sam and get the receipt for B2 visa and be done with the worries.
that seems to be cheapest way out.

I am just worried if I won't get a chance to explain my situation and LA office just collect all the documents and get into trouble.

Hi all, ChaloCanada's case got me thinking - Do you need to be in lawful/legal status in the US at the time your Canadian PR is issued? If your H1 expired and you decided to wait it out in this hell-hole, would you be screwing your chances? Just wondering.

You need to be on your H1 only till you get your nomination.

After getting PR card

Hi All

I did landing in april 2010 and came back to USA on same day,and got my PR card.My nomination was under Noc 2171,as many things got changed since i applied and now ANIP got suspended,do this will show any effect on my pr card if i want to move to canda within 6 months.
Do my PR status will be safe....

Its been more than three months since I did my medical exam. I sent an inquiry. Here is the reply from Buffalo.

"We accept more than 2000 permanent resident applications every month, most of them priority cases. Circumstances beyond our control can create backlogs.
Please note, processing times are simply averages and subject to change, they are not guarantees. As indicated on our website, the processing times noted are an average of files finalized between July 1, 2009 and June 30, 2010. Past processing times may not indicate the length of time it will take to finalize applications in the future."

Thanks for sharing that update. At this point looks like it is pretty much clear that Buffalo office is hitting backlogs .
All we can do is wait patiently for our turn till the files get transferred to another consulate, looks like will be a repeat of previous year.

Buffalo gets apps from other streams as well (FSW,Quebec,SINP etc etc) and with them getting more than 2000 apps per month this was to be expected.

Anywaz on a general front (addressed to everybody ) why all the gloom and doom on the site. Cheer up atleast all of us have a shot at this rather than the poor guys who got stonewalled with the changes at AINP recently .

Hang in there people.Updates will be slow to come am guessing.
