Newly engaged - How can I sponsor her after marriage

Hey Guys,

I am a PR since April 2012 and I came to India and got engaged 2 days back I am flying back this month end.

We are planning to get married in June 2014, but I want to get started on the process to sponsor her now.
Should I do an in Canada or out of Canada sponsorship, should we do a paper registration now and apply for sponsorship or would it be better to do a full wedding and then sponsor her next year.


Any help is appreciate...

Being engaged doesn't mean anything to the CIC. To sponsor you need to be common-law (living together for 1 year) or married.

So you can start putting your app together, and start collecting proofs of your relationship... but assuming you will never be living together you can't actually send your application until after the wedding and you have marriage certificate in hand.

For spousal sponsorship i don't think there are any specific requirements... you just need to show you will be able to support her in general, and you can't be on any social assistance program receiving money.

After marriage can she apply for a visit visa and be with me till she gets her PR
Not sure the visitor visa requirements from India, but the only way to guarantee she can stay with you in Canada until she gets PR, is to get her here on visitor visa and apply in-land. Once she is here and you apply in-land, she can stay in Canada the entire time.

If you apply out-land, then there is no special status given. If she comes on a visitor, student or work visa... she may be required to go back to India after the visa expires while the PR app is in process.

To do this, you must provide documents showing your financial resources for the past 12 months. This requirement applies only when dependent children who have dependent children of their own are included on the application."

Does it mean I dont have to show financial requirements for spouse, the statement is confusing.

and it says it takes 50 days for the sponsor and 10 months for the sponsored, does it mean it take in total roughly 1 year for her to get the PR?

I am engaged ( weddding is in October) I have the application basically together ( I do check to see if there are any changes in the meantime)

All you need is a plan. Job search, your qualifications. Your wife's ability to work counts as well.

If you're still in school, show relevant job openings along with your intended graduation.

If either of your parents will provide help or any other relatives/friends in Canada will also help, show letters and bank drafts if applicable.

I just graduated in dec will be hopefully start working in feb. Our parents can definitely help, could that help as well.

As others have mentioned, you don't have to have a job but you do need to show how you will support your wife - through savings, or assistance from family. So if your parents are willing to help you financially and/or with a place to live, they could write a letter to indicate as such. If your soon-tob-be wife is educated and could conceivably have good job prospects in Canada, that will count in your favour.

I considered this question myself before beginning my husband's PR, and the advice I received from the Delhi forum led me to agree that a civil registration isn't enough to ensure a successful PR process. Each visa office applies some sort of "cultural test" to applications under review. As you know, in India, it's not common for a couple to simply have a civil marriage. The norm is for a religious marriage with family and friends in attendance. So even if you think it would save time to do a civil marriage now and get a head start on the PR process, it's probably better in the long run to do the actual wedding as planned and apply after that. That way, you'll have both the civil and religious marriage certificates to include in your application as well as photos showing a typical wedding celebration (even if you plan to have a small wedding). The visa officer will look for and analyse these, as I know from personal experience (GCMS file notes).

Yes we are waiting for her to finish her masters so hopefully that will help, you are absolutely right about the civil marriage being an iffy so I guess our only option is to wait till we get married in June 2014 then apply for sponsorship. Is there a specific amount which I need to show in saving etc so that I can support her.

I checked the processing time and it says 50 days for the sponsor and 8 months for the applicant does it mean in total it takes a year for her to receive the PR if accepted.

I'm not sure anyone can suggest how much you need in savings to convince CIC you can support your wife...I don't want to hazard a guess because I simply don't know. However, many others on this forum were also students when they sponsored their spouses and they had no trouble being approved. In your case, you could focus on your and your wife's job prospects given your education, and see if your parents or other relatives would write a letter of support indicating you can stay with them or they'll provide financial assistance (assuming they are in fact willing) till you and your wife get jobs and can manage on your own.

The processing time for stage 1 (50 days) is likely accurate, don't know for sure. But the time for stage 2 (10 months for Delhi) is the average time it takes to process 80% of cases. If you put together a thorough and convincing application, you'll up your chances of being approved faster. I still think my obsessive-compulsiveness in putting together as near perfect an application as possible for my husband was what helped us get approved in 5 months despite the posted 10 month average. :) Good luck and come back with any further questions - this forum is an unmatched resource.

you have to show that you can support her, but there is no minimum threshold that you need to reach. So if you are not earning a lot of money, but can get free accommodation from family for example, then you should be ok. You should show to CIC that you have a plan to support your wife when she comes.

yes - roughly one year. New Delhi is a fast office though, and you might be done quicker than that. 10 months is the time it takes to complete 80% of the application, so if you have a straightforward case, well prepared and well documented, you might get it faster than that. Bear in mind that the first stage approval also varies - it was up to 100 days in the beginning of 2012. So planning for roughly a year, and being pleasantly surprised with less is the way to go!

Since you are already planning now - you can start being familiar with the forms, and start collecting proofs as you wait to get married, so it will be easy to put your application together once you are married. You can apply as soon as you are married( you need the marriage certificate) but you need to be back in Canada before you can send the application, as a PR you are not allowed to sponsor your partner from outside of Canada ( if you become a citizen before that date, then you can stay in India with her and apply for them, and move back together once the PR is granted).
