Rejected Nov 21

My employer will not apply for a new one since he has a feeling that they are rejecting lot of them and there is a big chance it will be rejected again.

Gosh.. Sorry to hear that bro.

I think we work for the same employer! Mine was also rejected last week for a similar reason. It sounds like they are just trying to find reasons to reject them at the moment.

Make that 3 rejections. Sorry about the rejection. Good luck with your plans going forward.

Luckily I have applied for a bridging work permit based on my CEC application so I should be okay, would have preferred the 2 year LMIA permit but at least I can stay.

So they called our HR department asking for information on me...I thought that the LMIA is just to allow the employer to recruit for a position and then the person applying will be assessed on whether they are fit for the position once they request a work permit... why am I now being assessed? They want information on me, my salary so far this year etc...? They originally requested 10 pieces of information and now they have requested 3 pieces since our lawyers reasoned with them. They said that they were probably going to reject it since they wanted to keep the high skilled positions for Canadians, yet then they asked for additional information. No rejection as of yet...but it seems perhaps on the horizon...will keep you posted.

So sorry to hear. Seems every week or so we get a result. So far I've counted 1 approval (Jay) and 2 rejections. Makes me nervous. What are your plans going forward @ calgarypr?

I am under FSP now, but I have received file number to late to do the bridging (2 months latter) so I will leave Canada and get back when I receive my PR.

What province are you applying from, I was from Alberta. Working for large Canadian sportswear company.

Also, I just contacted some of my friends from Edmonton. One of them is working for big transportation company and he said to me that his company has applied for 30 LMIAs for drivers and only 5 where accepted.
I guess Canada needs only low wage workers and not skilled workers.

SC seems to do that when the person is already working in organization. No sure what the rationale is but I've heard of such cases before.

I've come to realise this forum is now talking about all immigration processes as nobody is receiving LMIAs... Someone must get one approved this week!

haha..true. People just forgot about LMIAs now..

QUESTION GUYS

Should only employer call SC or can we if we know the file number?

In my opinion it would be better if employer call them. If you call and tell them that you are employer, they may ask you some question and you may not be able to answer or give them incorrect info about business..

Sorry to hear about your situation. Apparently, my employer got rejected for the same reason. I have applied through another employer as well so not worried much as of now. But yes, they are rejecting application in Edmondon. My employer applied Food Service Supervisor lmia from PIZZA 73.

Yep, same company. Our HR rep had the interview for both of our applications at the same time.

I have sent you PM.

Just got email from my employer, my LMIA application is REFUSED :(
Reasons: * You have not demonstrated sufficient efforts to hire Canadians in the occupations
* All advertisements must include the location of work and business adress
* All advertisement must include benefits package being offered

Explanation from my lawyer: The decision to reject, especially in relation to work address and business address is part of a shift in processing policy that has recently come about. The business address requirement in the advertising used to be met by satisfying the Officer that there would be no confusion as to where the employment was located

Again change of laws, and wages for provinces and occupations and mistakes from my lawyer leading to this decision. I don't blame SC at all.
My employer will probably resubmit application with new advertisement. This process will take another 2-3 months probably.
I am desperate, and will try now to find open lmia anywhere while waiting for this position.

My timeline:

NOC: 7311 - Mobile scale Mechanic/Technican
Wage: 30.00$
Province: Alberta

LMIA application sent via Xpresspost: October 17
File number and charged: October 22
Refusal: November 24
