Dear,
Thank you for your interest in working in Canada as a live-in caregiver. After careful review of
your work permit application and supporting documentation, I have determined that your
application does not meet the requirements of the Immigration and Refugee Protection Act
(IRPA) and Immigration and Refugee Protection Regulations (IRPR). I am refusing your
application on the following grounds:
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in
subsection 216(1) of the IRPR, based on the purpose of your visit.
• Your proposed studies are not reasonable in light of: your qualifications, previous
studies, missing mark sheets, academic record, level of establishment, language abilities,
financial ability, and/or your future prospects and plans.

So the first paragraph is a blunder....i didn't applied for live in care giver ... Then next paragraph is the refusal..
I would like to tell that i already have visitor visa of Canada and been there in June for a month....
I feel like that they refused just for the sake of refusal ....
What is your opinion

Hi! I would like to ask how to re apply or to appeal. I got a refusal letter last sept. 12 stating that they are not satisfied that the employers offer is genuine. I submitted the LMIA and Job offer together with my applications and requirements. I already contacted my employer about that.

Ps. My employer is my cousin's husband

I also got rejected and after reading this thread, I am planning to reply again, however, what do you mean by "reapply" is it that you fill a whole new application? or there is a platform where I explain and debunk the two reasons for my initial rejection? Please help me guys.
You have to fill out a new application to apply again

What is your opinion
next time when you apply, make sure to use strong words to point out their mistake. How can they be so irresponsible and write caregiver instead of study permit. It shows they didnt check your application properly. Also, do you have any 5.5 in IELTS?

Yeah there is definitely a blunder on their end somewhere.

Regardless, you need to apply again and address why their refusal is unfair in a polite manner with a letter of explanation. For every refusal reason that they have given, attach a document giving evidence that they are wrong and mention that document and its importance in your refusal letter. Check out my letter for reference.

Dear Authority,

First of all, thank you for putting your time to review my case.

This letter is about the re-application of my TRV. My preceding application was rejected with a couple of grounds. Anybody tell me to resubmit my application using a skilled lawyer. But I think my grounds for rejection are not complicated and they are because of my fault to represent incomplete documents. So, first I ordered GCMS note and it takes about 40 days to receive. I perused the officer note to resolve the weak points of my case and boost my strong points of it.

Please let me explain the reasons that were stated in the refusal letter and GCMS note, which are as follows:

I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your family ties in Canada and in your country of residence.

Justification:

We are a family of four. My father is working in the south of Iran very far from Tehran (the city of me and my mother’s residence). He comes back home every 2-3 months. Also my sister is living in Germany. My mother is about 57 and she is very dependent on me to do her own thing and housework.

Also in 2008, when I was a student in India, I bought an only 2 weeks German Shepherd dog. I called him Samuel. He is one of my closest friends from that time up to now. In 2012 Samuel courted another dog as a result of which they bred and I had 4 beautiful puppies. I gave 3 of them to responsible animal-loving people as I was truly concerned about their fate. I kept one of them called Oberon.

In 2015, I came back to Iran and unlike many people, I, an undertaking student, covered all their expenses to register them an application for their exit permit from Bangalore to Mumbai and Mumbai to Tehran-Iran. I spent 30 hours in Mumbai airport only to be able to accompany them during the flight.

Unfortunately about 9 months ago, Samuel got cancer and he is under medical treatment. Because of his painful life, our hearts ache in sadness, and our tears are flowing. (I have enclosed their pictures, medical record, exit permit proof). Because of the economic situation in Iran, governors have banned the import of pet food drugs. So many vets and specialist offer me to stop treatment of my lovely Samuel. But he is a member of our family and I pursue his treatment personally even though the cost is high.

I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on the purpose of your visit.

Justification:

This time I enclosed a hotel reservation receipt, official plane ticket reservation and a full itinerary for my stay. Also, I represent some occupation ties including paystub, Social Security Insurance history, Employment document, leave of absence letter (attached in the purpose of travel section).

I hope the above points as well as new attached document meet the requirements of the Immigration and Refugee Protection Act (IRPA) and Immigration and Refugee Protection Regulations (IRPR). I would love to have this Christmas in Canada after losing the beautiful summer of Canada.

All the details furnished by me and all the documents attached to my applications are true and correct. For any further clarification, please reach out to me on the below details and I would be happy to address your concerns.

Can sombody help me when can i reapply and please let me know the format of the letter for the justification since im planning to go in Dec 2019.

Based on this,my application was refused due to family ties and purpose of visit.My sister studies also in Canada.Might that be the reason?I reapplied again mentioning i have her there & she's doing her own studies to better her life and so they should take us as two different people.

Thanks for your reply...No I dont have any relatives in Canada ...this was just a 3 week family holiday plan since my son has christman holiday...
Also i have attached my son school certificates but no luck...i need to reapply again but ofcorse i need to have a very strong justification letter..i can even put some more additional documents like my India bank statement and my india house paper ...

I got 2nd refusal for Jan-2020 study permit,
  • First refusal was on 8th September. I applied through SDS. Received 2 reasons in Refusal Letter as:
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on the purpose of your visit.
• Your proposed studies are not reasonable in light of one or more of: your qualifications, previous studies, missing marks sheets, academic record, level of establishment, language abilities, or your future prospects and plans.

To overcome this, My agent just made a strong SOP explaining above without LOE and applied on 16th September.

  • Second refusal on 25th September. I applied through SDS with previous medical and biometric and then got refusal letter with 1 reason..
• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on the purpose of your visit.

  1. I have done B tech in CSE in 2014 and working as Software Test Engineer from 2014 till date.
  2. Applied for Cloud computing in Cambrian college Toronto.
  3. IELTS 7 with no less than 6.
I just applied for Caips.
Adding to this, My younger brother also went 1 year back to Canada for PG and now he is on Work Permit and I have added his detail under Family info, just a little about name and status in canada.


Can you please suggest how to process with? Any supporting documents or something to get the Visa and Do i need to show the property in my name along with my parents name in CA report?

Your Suggestion will be really helpful and appreciable. Thanks
