Immigrating back to Canada

Hi guys,

Need some advice on my current situation.

I moved to Canada in 2010 after getting married to a Canadian woman. I received my PR card in 2012.

We have two kids together (Aged 6) but we ended up separating in 2017, and I moved back to the UK.

My PR card expired in 2017, and I did not renew it.

So now I've decided that I want to move back to Canada to be closer to my children but not sure how to go about it.

Can I just renew my PR card, or will I have to go through the immigration process again?

I did go to college in Canada and received a Diploma and have work experience in Canada.

Any advice would help

Yes, I do have a British passport

Complicated I say. In order to travel you need a valid PR card. As a British citizen you cannot get eTA either.
You would have to get to the US somehow and then cross the border in a car or by foot. They will let you in and report you for not meeting residency requirements.
That's my meager understanding..but let's see what others have to say

British passport doesn't really help you.

You don't qualify for an eTA, don't have a valid PR card and can't get a valid PRTD. So flying direct to Canada isn't possible. Your only option (without applying from scratch) is still to fly to the US and then re-enter Canada through a land border crossing and hope you are not reported.

The issue with that is I am unable to fly to the US as I had been banned back in 2014 for overstaying my Visa by 2 days.

In that case you may have to renounce your PR and come as a visitor in future.

Are you 100% sure you have a ban?

Normally US bans only kick in once you've overstayed more than six months (3 year ban) or more than a year (10 year ban).

Anyway, if you can't enter the US, then you are pretty much out of luck for saving your PR status. You can try applying for a PR Travel Document with H&C considerations. This is almost guaranteed to be refused but no harm trying. Once it's refused, your PR status will be officially revoked. At that point, you'll then need to apply for PR from scratch through an economic immigration program like Express Entry. Success will depend on your profile (level of education, profession, etc.).

Just to add a futher comment on this...

If you overstayed by 2 days, then you definitely no longer qualify for an ESTA to travel to the US (since you violated the conditions of a previous stay). You need to apply for a regular US visitor visa (B-2). This is a more involved process and normally requires an interview.

This of course assumes you don't have a US ban. You haven't given us the detailed info on your time in the US so hard to confirm your situation.
