yes you are eligible based on receipt date
As cook I'm one of the most interested on believe that receipt date makes me to be safe, but on IMM5609 says...

"Staying informed
Selection criteria, requirements and other information for applicants can sometimes change. Please note that:
Applications will be processed according to the rules and regulations in effect at the time they are received. Rules and regulations may change at any time; changes may be applied to applications which have already been received."

don't know how to interpret the backgrounder line "CIC already has a large inventory of applications in these occupations and will continue processing them to a final decision."
Any ideas?

you're good if you get AOR, if you made a mistake and they return your application, you cannot apply for CEC anymore

Any sane person will give u advise that you need to be positive and based on my previous experience they should classify your application under
old rule. But, I encourage u to check ur provincial system if you have special class for cooks like in ALBERTA then why dont apply for it too. Getting infromation from GCMS notes before that will also be a good idea to know the status of your application which can give you some peace of mind.

You seem to be telling people about Alberta in multiple threads

The following are NOT eligible under the AINP Employer-Driven Stream:

Supervisors, foremen and tradespeople, working in a Compulsory or Optional Trade in Alberta (including Chefs, Cooks, and Line Cooks)
Why don't you point these people to the exact resources online (official sites only) and guide them to pages where it shows that they can apply for program X, instead of just posting your mind set.

Hi Rose, you know they received it when you have your AOR by e-mail. it is taking about 50-60 days

I sent the application package for NOC 6311 on November 8 2013

Hi I sent the complete application package on November 8 and after sending I came to know that rules are changing from November 9, and my file has not been received yet, according to Canada post it will be received on 14 November. I just want to know if the immigration will still consider my application under NOC 6311, I also validated my forms in September or October.
And my application is genuine because I am actually working in health care under that job title as food service supervisor.

And if immigration doesn't accept my file then what should I do then, I already have experience in this category for almost 17 months now and still working.

Anybody have any Idea?

Thanks

Think you're ok since the 'send date' time stamp on your application shows November 8th.
If you shipped on the 9th you might also still have been ok, after that the new rules apply

Not to encourage sharma1987's multiple post, but...

CIC assesses your application package according to the rules on the day it was delivered, not the day you sent it.

You can check the delivery date by looking up your tracking number on the Canada Post website (or at whichever courier service you used), or if you do receive your AOR, the date is viewable in CAS.

Can you show me some source that proofs that? How is that fair for people who apply on the 7th or 8th? They do not publicly announce that they are changing the rules so if I sent in my application on the 8th, I did so in good faith and even if they receive them on the 10th, I don't think it matters as long as the application was sent to them earlier.

If you prepare your application and sent it out on the 10th, then you could have known about the updates rules. Otherwise I don't think it will impact you. But I might be wrong, it just wouldn't be fair

If you feel that it's unfair because people deserve advance warning about changes to immigration eligibility rules, then many here will not disagree with you. The harsh reality is that the Canadian government does make sudden changes to these rules from time to time.

"All CEC applications will be considered according to the date they are received at the CIO." (http://www.cic.gc.ca/english/resources/manuals/bulletins/2013/ob554.asp). I can verify that the 'application received' date shown in my CAS matches the delivery date in my tracking information. Besides, how would CIC even know when you sent your application?

thanks mrforce, gladaki and lps, http://www.cic.gc.ca/english/resources/manuals/bulletins/2013/ob554.asp, this note on the gazzete gives me some relief, looks like they are going to review applications received before nov 9th with the old rule, even when imm5609 says changes will affect all the applications...nothing else to do but to wait and trust in God, finger crossing and praying...
