I'm also having an issue with the automated telephone service IRCC.
Previously, when I called, the system would say "background is in process" before transferring me to a customer specialist. Now, it doesn't say anything — it just transfers me directly. After that, I’m left waiting, but no one answers. I eventually have to hang up.
Can you please let me know what this means, and if this has happened before?

When you hear this message, that means decision has been made on your application. This decision could be eCOPR, or any other decision, including return of the application.

This mean ,If you got AIp already then FD is made on your application .
 
My H&C application was refused.

My lawyer says to appeal first, then check the notes and decide what to do next. But the lawyer is charging a lot, so I'm thinking of changing lawyers.

Should I appeal or apply for H&C again?

If I appeal, how long does it take to get a result? And if the appeal is refused, can I still apply again for H&C?

I'm shocked by the refusal. I put everything into that application.

Sorry to hear that. I would suggest working with lawyer and file for judicial review to stop removal order. At the same time, you may submit another H and C application. Unfortunately, this H and C program does not make any sense these days, strong cases invloving best interests of children are refused and weak cases involving parents/siblings are approved. This will utlimately result in a large number of cases at federal courts.

Still can be removed. You can try to have your removal put on hold until you receive the outcome of JR. The quotas are now incredibly small and IRCC had become very generous when it came to H&C approvals.. The H&C program became much less about rare exceptional cases and more of a default program for anyone who was refused from other programs like asylum. People were even able to apply for H&C multiple times and even though they kept on being refused IRCC/CBSA never took any action. IRCC has now started to verify information and look for inconsistencies as well in all forms of PR applications as well as enforcing removal orders. In general immigration is being tightened in Canada and Canada tries to reduce the volume or temporary residents and yearly PR approvals.

JRs in general are expensive to file because it takes quite a lot of time to put together. You need to have a conversation with your lawyer about reason for refusal and chances of JR approval. Also realistic chances of obtaining PR via H&C. Returning home and working towards PR from abroad may be a more realistic way to obtain PR. Tough to say without knowing your case which is why your lawyer may be the best person to consult.

whats your timeline? because the ircc is crazy for now.

I am so sorry to hear this. Please note that this isn't the end. I am not an expert to advise on this, however if you can't pay the hefty fees of the lawyer, you can check if you're eligible for legal aid. I have seen in this forum that few people did apply on their own and got successful as well. To me, the lawyer didn't do much and I tried to put every thing on my own. Refusal notes do matter to plan the next move. Wish you good luck :)

Apply H&C in AUG 2023 and in MAY 2025 they refused the file.
Mine was June 2023. I think they skip my application. I have both H&C and PRRA and last updated was they combined them. After that combination they just didn’t touch it. What could be a reason for this @canuck78 ? We were thinking if you have two applications they process faster however it doesn’t seem like that.

Applications are not processed in a strict chronological order. Some applications take longer to process because they are more complicated, have a larger file to review, may involve multiple people versus a single applicant, case officer receives information from a 3rd party at a different speeds, etc. The case load of the officer assigned to your case can also have an impact on processing. Not sure what you mean by combining H&C and PPRA. They are distinct applications with different purposes and assessment criteria. Do you mean they are both being processed and you are scheduled to hear the outcomes at the same time? Have noticed that there have been a few recent cases where applicants are receiving the outcomes of both applications at a meeting with CBSA. If PPRA is approved and the applicant has no criminal record IRCC may be more inclined to approve the H&C application. This may predominantly be an attempt to streamline the process and reduce administrative burden of processing multiple types of applications at the same time but that is just my theory.

If I remember correctly you also submitted an applications that was thousands of pages long. I am not longer able to see all the previous posts since the last update and just the most recent ones. Am I remembering correctly? If that is the case that would also impact speed of processing.
