There is nothing for her to file a complaint about - she signed an undertaking with her government to provide support for you for the next three years. If she doesn't want to stay married, that's fine - but that has nothing to do with your right to stay in Canada, or her obligation to you under the law.
This is clearly spelled out in the
Sponsorship Agreement that is signed and submitted with the application. It is a contract between the applicant and the sponsor, and the following information implies that it's enforceable in court.
Obligations of the Sponsor
As sponsor,
I promise to provide for the sponsored person's . . . basic requirements for a period that begins the day on which the sponsored person enters Canada and . . . becomes a permanent resident and ends: if the person is a spouse . . . on the last day of the period of 3 years following the day on which they become a permanent resident.
. . .
Basic requirements include food, shelter, clothing, fuel, utilities, household supplies, personal requirements and health care not provided by public health, including dental care and eye care.
I promise that financial obligations or
other personal circumstances over the applicable period referred to above will not prevent me from honouring this agreement and the sponsorship undertaking I signed . . .
I promise that the sponsored person . . . will not have to apply for social assistance benefits; and
I promise to respond promptly to requests for help . . . by giving money, buying items or providing services for their living expenses.
Obligations of Person Being Sponsored
I promise to make every reasonable effort to provide for my own basic requirements . . .
I promise to ask my sponsor for help if I . . . am having difficulty supporting (myself) or meeting (my) own basic requirements.
Important Information
Sponsored persons who are being abused or assaulted by their sponsors should seek safety away from their sponsors even if this means they have to apply for social assistance benefits.
A sponsor cannot force CIC to remove you from Canada.
An undertaking is unconditional and cannot be terminated.
Under no circumstances does the granting of Canadian citizenship,
divorce, separation or relationship breakdown, financial deterioration or moving to another Province cancel the undertaking.
Legal & Financial Consequences
If the sponsor does not provide support as required,
the sponsored person can take legal action.
Do yourself a favour - be proactive and get yourself a good divorce attorney. Don't become a victim in all of this by being bullied into believing your soon-to-be ex has any ability to have you deported . . . she's just trying to get herself out from under the agreement she signed. Don't let her do it! I'm not saying you should quit your job and apply for social service benefits just to screw her . . . but know what your rights are and don't be intimidated into thinking you have to leave Canada . . . because the only thing she's trying to do is make things easier on herself. A good attorney will be able to tell you how to proceed. You are in Canada now, you have the right to stay here and make a life for yourself, regardless of whether it's with her or not.
