Privacy Act refers to information kept about yourself by the government or its agencies. Therefore if you are individual inquiring about your own file (such as your immigration file-GCMS) then you can choose Privacy Act.

Access to Information Act is gives individuals a right to access records under the control of a federal government institution in accordance with the principles that government information should be available to the public.

Simply put, in order to benefit from these acts you have to be physically present in Canada. If you are submitting for information about yourself then use Privacy Act. Access to Information Act comes in handy when you reside outside Canada and use a family member, friend or 3rd party to request information on your behalf. They would submit their request using the Access to Information Act.

correct me if i am wrong, cio transfer file to ottawa, is that mean status is already IP ? Is tht mean i should wait for DM soon?

Hi Hamid,

Yes As there was note in my Gcms that , complex case - referred to visa office for further processing ' , i was worried..

But in my notes somewhere they mention that file is intransfer on 26 may. Further, today i got an email from Cio sydney that they transfer my file to ottawa in month of may, so now my file is in ottawa..

As i seeek help from some friends, they told me that if file is in ottawa then its very close to last stage and ottawa is responsible for DM and Passport request..

I am hoping that ottawa send me DM or ppr soon..


In my gcms notes, there is no any commnet about my wife's previous refusals... no any single comment. .. so i believe they just want to varify the previous rejection reasons..

i also become so nervous bcz my wife also refused twice
after your post i talked two lawyer and 5 of mine friends
none of them said it will be any bad effect our PR application

I am september 26 applicant medical done both me and my wife rprf paid upfront
there are few applicant same timeline me like got IP/DM so after your post i become so worried
then i talk lawyer and friends every one said no connection Temporary and PR file

now you said you got email from them

so i am little relax now

[SINP 2014 PNP]

i have one question to all friends

i m in canada as a close work permit

so my wife from back home apply 2 times open work permit and she was refused both time

can it would be bad effect on our PR application

GCMS note :
it says PA applicant got married 2011 he also live other country before came to canada

it appears PA and spouse have never lived in the same country in the course of their marriage
they have elected to live separately since they married in 2011, I fail to see the any H&C measures to reunite them now

Hi, There is no any Effect of Previuos Application refusals on your PR application as you are already a PNP nominee.

The matter is they make our file delayed.. As we have depend in our file and she was refused 2 or 3 times, Officer would take more time on background check and cause delay the file.

By the way, whats your ECAS now?

Hi he is September applicant same like me
So I asked him in his inbox he replied it show application received

I have three friends of mine, they have dependent on file and they have several refusals previously. . They all got the PPR last week but they confirmed that they got Delayed in DM after IP. They states they waited 2 months to get DM after IP. And the next day od DM was PPR.

in this forum PNP we didn't see any refusal about this issue
if bcz of spouse previous refusal of open work permit does effect PR application then we might see lots of case about this
but didn't see much

Yes for Sure..Other friends getting their PPR early that doesn't mean there is something wrong in our case. It is just matter of assesment takes time.

Everything will be fine..our PPR on the way..

That is not only the reason behind delay. But ya it could be. And i m sure . Delaying the result doesn't mean refusal.. so be positive. We will get our soon.
