Applicant has applied as the other relative pursuant to Section 117(1)(h) of Immigration and Refugee Protection Regulation which states that a foreign national is a member of the family class if, with respect to a sponsor, the foreign national is a relative of the sponsor, regardless of age, if the sponsor does not have a spouse, a common-law partner, a conjugal partner, a child, a parent, a grandparent, sibling and uncle, aunt, nephew or niece, who is a Canadian citizen,
Indian or permanent resident, or.. whose application to enter and remain in Canada as a permanent resident the sponsor may otherwise sponsor.
Sponsor has two siblings according to additional family form dated 2026/02/20
Since sponsor’s sister is alive and living in India and can be sponsored to Canada as a
permanent resident, I have concerns that you do not meet the definition of a family member as per R117(1)(h)(ii).
I got pfl today they saying I’m not eligible as I have sister is alive and could be sponsored. Their website says you could sponsor one relative of any age and I picked my adult brother. Btw my sister is adult too. What to reply have given me 30 days. I’m single no spouse, kids, uncle, aunt, parent and grandparents are alive or present in Canada. I just have two siblings back home who are 40 years old.
