I tend to agree with others here. especially because you are unable to prove with documents such as Service Certificate; pay slips; bank statements; labour card; or other statutory documents beyond reasonable doubt.
Would you atleast have job offer letter on company letter head with sign, seal and mentioning your salary ?

I have VISA stamped on my passport which clearly mentions my occupation as SALES and my employer's name. Yes I have offer letter on company's letter head PLUS i have reference letter on plain paper from the director of the company since no letter head available now as the company is closed.

Would that be enough?

Would 50-50 commission structure with NO salary would be considered as PAID employment in order to claim points???

The offer letter will be considered as documentary proof of employment with the ref. letter.

The VISA itself will not be accepted as proof of employment.

Now I believe your emp. contract mentions your start date inclusive of when you were working on Visit Visa for 1 year ? Does the contract clearly specify that you will be working on Visit Visa or anything along those lines ? If Yes - does it mention the 'reason' as to why you cannot be provided with an Employment VISA instead ?

I checked with their call center, and they refused to issue additional TRF's to individuals.

Post this on the IELTS Timeline. People have been able to acquire additional TRFs in the past.

No it says nothing of that sort, bro. It only mentions that I would be on probation for 6 months. This is what it says:

"The first Six (6) months of the employment shall be probationary period, during which time employment may be terminated with or without cause by either party without any notice period or severance pay."

Do I need to talk to the director and request if he could modify my offer letter now and made it from the date I was issued employment Visa or give any genuine explanation to this. What do you suggest...there is no other way.

I would like to understand what's your Employer's stand on this. Do they agree that having you working on Visit VISA was not the legal procedure or are they perfectly okay with it and consider it a normal procedure? Not that it would matter to CIC as the procedure is not correct, but I am trying to understand whether your employment contract mentions you working on a Visit Visa during probation in any way?

Either-way, I would suggest you request them to modify the Employment Contract to show the start date in sync with the Employment Visa and not Visit Visa.

I think I should speak to them about modification of the employment contract as for normal situations this could have worked but with PR and Visa related situations such casual stuff may not work.

Also, my employment Visa was first issued by a subsidiary/sister concern of my actual employer...so basically my stamped Visa mentions 'ABC LLC' as my sponsor while I was working actually for 'XYZ LLC'. However, after 1 year that subsidiary's Visa was cancelled and I was moved on the visa of my actual employer i.e 'XYZ LLC'. Can this be of any IMPORTANCE or issue for CIC as there would be a mis-match of the sponsor of the employment Visa and Company giving Offer letter and employment ?? Though this is a common thing in UAE.

I understand that your Sponsors changed as far the VISA is concerned. But, if I understand correctly, your 'Employer' for whom you worked, and the one providing you the ref. letter, remained the same? If - So, this is not an issue at all. But do prepare a covering letter to explain the whole thing and submit along with your application.

Yes, you have got it right.

I am trying to get a trade license copy of XYZ and ABC both, since both these companies have same UAE citizen as a sponsor I guess this would be enough to show the connection between two.

Do you have any idea if working only on commission and NO SALARY is considered as PAID employment by CIC or not?

My employment visa was initially arranged and issued by a subsidiary company of my employer and only after a year this Visa was cancelled and I was transferred on the employment Visa of my Actual employer. Both these Visa are stamped on my passport including all those visit Visas. Would this be any issue for CIC since my Offer letter and reference letter state the Actual employer and not the subsidiary company ??

Will they consider my 2.5 years of exp including the time I worked on Visit Visa, or they may raise a red flag on me since I was working on Visit Visa in a different country.

Can someone pls help...If there are any issues in my experience, any solution for this situation? :'( :'(

I have been reading all the responses you are getting to your post and I thought I would add my 2 bits (perhaps it may help you):

1. What names were mentioned on the work visa (after you got the work visa that is) is irrelevant to CIC, so you don't have to worry about that. The company I worked for had a different name in Dubai and Abu Dhabi. I was on an Abu Dhabi visa however, all letters issued from HR were from Dubai and it was not a problem (I did not send any cover letters, etc.).

2. What is relevant to CIC is the dates on the police certificate that you will submit. The dates will reflect the day you entered UAE with your work visa (which later got stamped on your passport as Residence visa).

3. From my point of view your problem is not from what date you can show employment is the Dubai, but rather from what date you can say you resided permanently in Dubai on your background form. I both agree and disagree with other people on this forum in terms of what they have advised you:
  • It is indeed illegal for anyone to be employed full-time in a country while they are on a visit visa.
  • It is however not illegal for you to go to another country (in this case Dubai) for work and conduct business transactions on behalf of your company while on a visit visa.
To summarize the point that I am trying to make here is that, you can show that you were employed by that company full-time since day one, however you cannot show that you were a resident of Dubai during this whole time. The best solution for you is to declare that you were employed as an offshore employee (in your home country), who made frequent trips to Dubai on business and then you became an onsite employee after your transfer to Dubai. Things like where your salary was deposited and if you had any work in your home country, etc. are not relevant to CIC because in giant reputable Multinational companies, living in one country, getting paid in another and working in a totally different country is not unheard off.

With all this said, you need to tread very lightly, as you were indeed working illegally in Dubai and drawing unnecessary attention to this fact by sending cover letters etc. will hurt your case (my opinion only). You can however send these if the visa officer asks you for further clarification at a later stage.

Contrary to another member's advise, making sure you worked on the correct visa is the employers responsibility and not the employees, as per UAE law. Had you actually been caught, I am almost certain your company would have said the exact thing I wrote above (i.e. you are an offshore employee, there on a business trip).

Dear Bro +1 for your detailed response. But I need few more suggestions based on following points:

My company did not have any office in India so showing that I was employed off shore i.e in India would be Okay ??? Moreover, In the 11 months preceding my Employment Visa...I did not even once travel to India so basically I was whole time in Dubai on Visit visas and used to travel Visa FREE Zones to exit and entering back in Dubai...Would that not be unusual for someone who is employed in India BUT stays in Dubai for straight 11 months for 'Business transactions or for clients Visits' ? Just to clarify further I was working for a Real Estate company but on Commission with no Salary condition..so I do not have any salary transfers to show in Bank accounts, In fact I do not have any trace of my Dubai Bank statement now...I was working there 7 years ago. Any Idea if this employment for which only commission is paid is considered to be PAID employment by CIC or not?
