Hi Experts, I am looking forward for your suggestion on how to go with my profile for child Sponsorship.

My wife and I are PR holders since 2017 August, however she left to India immediately after landing and I continued to work here for a while. We had our first child in India and tried to initiate a visitor visa for child in 3 mths itself. Visa got rejected with the reason saying the parents are PR holders and cannot issue visitor visa for Infant. and asked us to process PR directly. Unfortunately we were in India continuously and criteria says one of the parent has to be in Canada to process the Child Sponsorship.
Now I travelled back to Canada alone in 2021 and my wife, kid are in India.

I am planning to go with any immigration consultant to help me with sponsorship application because
1. I kind of have a bad credit history and afraid if that will screw things up.
2. Also my child visitor visa was once rejected when she was just 3 mths old, not sure if that will cause any impact now.
3. Irrespective of these conditions, if my child gets PR this yr and I bring my family, wife and Kid will have end date as mine which Nov 2022, which means not sure if they will be eligible for the extension. Can you please guide me with some solutions or suggestions?

So when the child gets the PR, they will travel and will spend less than a year until Nov 2022. wo what would be criteria to have them extended?

The 2 out of 5 year residency obligation is based on your landing date - not your PR card date.

Your child's PR residency requirement will start from the time your child lands in Canada and becomes a PR. This has nothing to do with Nov 2022.

Your wife needs to return to Canada if at all possible before her PR card expires. If she is reported at the border for failing to meet the residency requirement, then she will have to appear at a hearing to argue why she should be allowed to keep her status. If she is refused at this hearing, she can appeal the decision. If the appeal is also refused and she officially loses her PR status, then you can sponsor her for PR. If, on the other hand, she is able to enter Canada without being reported, then she would remain in Canada for 2 years straight and then apply to renew her PR card.

Yes, you can certainly try for another visitor visa in parallel.

How many days have you been in Canada since you landed in 2017?

Lets assume that my child gets PR in Oct 2021. Child will have 5 yr PR so no issues but my wife will only have until Nov 2022 as I said earlier. Lets say they are travelling here in Jan 2022:
1. will my go through any complications in immigration as her PR ends in less than 1 yr.
2. if she is able to enter Canada with no issues, can she stay beyond Nov 2022 for another 1 yr also? In that case she will complete 2 yrs and will become eligible for extension. Question is, can she stay beyond end date mentioned in card or she has to go back and i need to initiate new PR process again ?

I was there for a year and now I am back and will be here till 2022 Nov. Also i spent quite a number of years in Work permit.. for me, it should not be a problem in getting an extension. I am worried about wife and child status

The time you were here on a work permit does not count towards the PR residency obligation. Make sure you have at least 2 years in Canada out of the last 5 at the time you apply to sponsor your child.

You need to meet the 730 days between August 2017- August 2022. If you wife arrives without being reported she will need to remain in Canada for 2 years straight.

Is it advisable to process the child sponsorship on our own or good to get any law firm support? They are asking 2500 CAD for the child sponsorship...

I need your guidance in filling out the form IMM0008 - ADDITIONAL DEPENDANTS / DECLARATION FORM

I am in the process of applying child sponsorship. My daughter is 3 Yrs old and Born outside Canada. My Wife and I are PR holders.
I am not sure if this form is applicable for this sponsorship.
My child is the principal applicant. Am I correct here? Which means she doesn't have any dependents on her own.
I am not sure if this application form has to be filled out from the perspective that child is the principle applicant or the sponsor (in this case it is me)?

Question 10: Relationship to principal applicant. This is where I was confused and not sure if this form is applicable in our case.

Please advise.
Also Question 3 is asking for UCI. It must be left as blank right?

The last 2 years I spent my time in India and now back in Canada processing for child. The questions is askig for the last 12 Mths net income details. If i convert the Indian pay in CAD, the amount seems to be less. Should I give that way or give the income info for the next 12 yrs? Please advise


In addition to that, I need to give supporting documents for this. The last 2 yrs of CRA assessment doesn't show much as I spent time in India. So I am planning to give CRA Assessment copies from 2016 till 2020. Is that ok?

I am not as familiar with the specific application requirements so keep this in mind.

BUT: I don't believe that there is a specific income requirement for sponsoring your child - only that you show how you will support the child.

So tell the truth, and if you wish to provide a letter of explanation (with supporting documentation where available) about your current income, savings, etc, then do so. I do not think including five years of CRA assessments is necessary but if you wish to include the most-recent-before (i.e. 2020), that may be helpful and won't hurt. (Adding the full five years would just be excessive)
