So I lived in Canada for 10 months, with valid visitor status, all was well.. I'm in Argentina now and my fiance is in Canada. He is waiting on his divorce which will hopefully be done soon. ::)

We had initially thought that, once his divorce was final, he'd come down here, we'd get married, I'd apply outland, and then try to fly up again as a visitor and see if they'd let me cross the border to wait with him while my App was in process. We thought the fact that we would be married + with a PR app in process would give me better chances of being admitted back.

But reading all the threads here I'm not so sure I was right anymore. All these husbands and wives being turned away at the border because having a husband in Canada is a reason for them to suspect you are going to stay indefinitely/illegally/etc.

Now I'm thinking.... maybe it would be better to try to come up now as a visitor again, get married and apply from there? I keep thinking they will turn me away for wanting to come back so soon (I left about 6 months ago) .

I hate the uncertainty.. Does anybody have any suggestions at all? I've been looking all around the forum but opinions seem to differ..

Also if you read around this forum quite a few people that do wait out the process with there spouse in Canada.

Go to the border completely prepared. You would have to bring with you a copy of your application, proof of payment, proof of ties to home country. Also proof you can support yourself for up to 6 months eg. copies of bank statements for yourself and spouse. It would even benefit you both if your husband was with with you. Alot of people are even given more than the 6 months visitor status. If they don't give you that long you can always extend it.

No, I know that him coming with me supposedly helps, and I know all the stuff I need to bring (I would bring all those documents whether I was married already or not) ... but last night I was reading and there were all these husbands/wives that got turned away.. almost like being married makes your case worse, not better, as far as being able to enter Canada under a tourist status. I don't know, I just want to figure out what our best chance is..

I guess you can brong everything that you can and hope for the best. I guess it all depends on the IO that greets you at customs. I'm sure if you're well organized you shouldn't be denied.

If it was me, I would come up as a visitor, marry in Canada, and apply OUTLAND from within Canada. Very unlikely that they would turn you away if you are coming up as a visitor. Just my 2 cents..

pegasusyt, we're in a very very similar sitatution.

The first step for you is to apply for your visitor visa. This is not a simple as you think. Read through my posts last summer, we succeeded in bringing my fiancee here from Brazil last summer so she could meet and spend time with her new canadian family. We could not get married yet, as I did not have my divorce certificate at that time. We really thought we would not get the visitor visa. It is very difficult to get depending on your situation.

Now, we think it will be harder for her to get a visitor visa to come visit again, you have to be honest and say that you are coming as a fiancee. We will try regardless. If all goes well we will do 2 weddings, one in Brazil and one here in Canada. The one in Canada may be after she gets her PR visa if she denied a visitor visa.
