hi Guys,

I am in awkward position right now.
So i was on a PGWP in 2013-2014. I applied for OPNP back in 2014 and just received the nomination. My Current status is Visitor and I have been on it Since November 2014.
I am reading right now on CIC that a visitor may not apply for a WP inside Canada, is that true? I do have a nomination and all the compliance fees paid by the employer already and a work permit support letter from Ontario Government.

So How to I apply for a closed work permit inside Canada on a visitors status?

Your suggestions on this topic would be very helpful.

You need to flagpoll at the border - leave Canada and return, and you can apply for a closed work permit with your support letter when you re-enter.

I unfortunately don't have time to write out the whole process right now, but search this forum for "flag poll procedure" and you should get some help. I will explain better later tonight if nobody else has done so earlier! Good luck!

Thanks for the quick reply, Yes I read about the flagpole procedure. But the problem is I have no Visa to the US at the moment. I am curious if a regular Online application will do for a CWP?

Hi ko_ ko_ ko
We don't need a U.S. Visa to get work permit at US-CANADA Border when you go there say to US Officer you just came here for Flagpole to get work permit .....he will give a yellow colour paper and say u to go in U.S. Immigration department......then they will give u a paper and they will open the gate for you to enter directly to CANADA Immigration ........then explain your status and they will give u a work permit.....!!

if you have the visitor's visa you can send the application package of extend your stay as worker to US.
If you have applied for PR then you might be eligible for OWP

This is confusing as a visitor record is still considered a TR status. Also if I apply online shouldn't that work out? in terms of changing status to worker.

If you are on visitor's status you cannot apply for work permit from within Canada. You have to apply from outside Canada, in your case it will be processed in US.

But if I apply online they will send it to USA themselves right?
 
Do you live near a border? The flagpoll process really is quite easy. The key is making sure that when you get to the US side you tell them that you're flagpolling - that way they will treat it as you "voluntarily withdrawing your intention to enter the United States" rather than them actually denying you entry. Then they turn you around and you're back at the Canadian side - there's no record of you having been outside of Canada, yet you're able to apply for a work permit from outside of Canada. It's a great trick!

I'm on the west coast so I did my flagpoll at the Peach Arch - parked the car on the Canadian side and walked to the US and back through the gardens.

Thanks! I am in Toronto, Looks like the closest border would be Niagara.
 
That's definitely close enough for a drive, and you can make a nice day trip out of it. I imagine you can even do the flagpolling on foot. My recommendation would be to make sure all your documents are in order, take everything with you, and head down to Niagara. As long as you have a valid passport and the work permit support letter, and are not currently out of status (which you're not as your visitor visa is currently active), you should be fine. If you're most worried about the US side of things, I'd suggest getting in contact with US Customs and Border Protection to set your mind at ease.

And as I always say, if you have any doubt at all, consult a proper qualified immigration lawyer. I'm pretty sure I'm correct with this one, but I'm also just a dude with an opinion on the internet... ;)

Thanks! Yeah, I`ll call USA border agency and find out. The CIC agent told me that in any case I need to do a border crossing, even if I apply by paper to New York, so might as well go do it this weekend.
 
So I went and did a border polling procedure. Spend 14 hours at rainbow bridge Niagara terrible service.
After my 14 hours of wait I was not issued the WP, the officer said I need to file the application outside Canada, Either USA or Country of Citizenship.
Now I am trying to lookup what to do exactly, but I am getting very confused with the VAC, especially the one in my home country, so I was thinking to send it to the US.
But again sending it to the USA is a pain too, I was trying to see if I can directly send it to the consulate to skip the VAC process.

Did anyone have a similar situation?
 
I have question regarding my work permit extension. I am MPNP nominee applicant and my medical is done for federal PR.My open work permit ig going to expire in NOV 2015 and I am hoping to get my PR before that but in worst case senerio if CIC will take more time and delay in PR then I would need to extend my WP.I want to apply for open work permit not close.I am just wondering can I apply for bridge WP 4 months prior before my WP gets expire ? I am looking to change my job actually as I am getting really got job can I do that without having any issues with my WP extension ?Any help would be really appreciated thanks
