I recently received an invitation in AAIP - Accelerated Tech Pathway (NOC 21230) and submitted my application on 6 Feb. My PGWP is expiring on 10 March and employer will not provide LMIA. However, they are wiling to keep my position open for up to 6 months after I stop working, and they will rehire me once I have valid work permit or PR. They are willing to provide a written letter confirming this.
From my research, it appears that AAIP may still gives nomination under Tech Pathway as long as job offer remains valid and I maintain legal status in Canada. Based on that, I am considering applying for a Visitor Record before my PGWP expires and stop working on or before 10 March.
I consulted two immigration advisors to verify this, but both suggested me to apply for Bridging Open Work Permit without AOR, along with letter explaining that my application of PNP is in progress. They explained that since work permit processing takes time, I can continue working under maintained status while waiting for nomination and later update the application once I receive AOR.
They further added that even if work permit rejects before AOR, I can restore my status as visitor and continue waiting for nomination or PR.
I’m aware that a BOWP cannot be approved without AOR, but if I still proceed with the BOWP application, could it negatively impact my PR application in any way?
Also, I would like to confirm whether AAIP can still issue a nomination under the Tech Pathway if I follow the safer option mentioned earlier (switching to visitor status and stopping work).
I would really appreciate any opinions or recent experiences.
