Hello,
I am in Canada with my spouse who is a full time student and working with CRA as well. We applied for our PR and got nominations from the province as well. When we moved to Canada my wife had ckd but with a referral from the doctor she got her visa. Now IRCC asked for another medical from her side and my medical got passed. she is currently not on dialysis and don’t have any other medication. I was wondering if someone can guide us on that. I am the main applicant and an open work permit holder. What should I expect for my next move and what are the chances of getting PR? Please please please help

Nothing you can do but wait for her to pass the medical. If she gets a procedural fairness letter for her being a burden on the health system, then hire an immigration lawyer. You will need to compile documentation that she will not be now and in the future. So you will want documentation from doctors that she will not require dialysis or transplant now and in the future.

It's possible for the visa to be approved and for PR to be refused depending on how the medical is assessed. But hopefully that won't happen in your case.

A work visa is different from being approved for PR. Work visa is temporary. When was her visa approved because IRCC wants assurance that her health has not deteriorated. Your PR will not be accepted if she doesn’t pass the medical. Again, you need to wait to see if medical is approved. Then you will work with approved IRCC panel physicians and they will bring in specialists to review her case. Assume your nephrologist in Canada or approved IRCC panel physcian, and understand the Canadian health care system. So she will never need dialysis or a transplant?

Your wife must pass the medical in order for your PR application to be approved. If she is refused, then you will be refused as well.

We did our medical back in 2021 October and since then apart from kidney everything is good. Her disease is a genetic one where every other conditions are normal except the kidney function as in these cases you don’t know nothing can happen or anything can happen. But given that she is still a student and we haven’t got our PGWP. Do you think it will be a hard run for us??? I am very scared and thinking what to do??? I am also thinking of buying a property but now don’t know what to do??? The doctor said she can have a transplant within six months if she gets a PR as her other conditions are quite good…..

What do you mean by this? Do you mean that she needs a transplant soon?

None of us can guess the chances of approval but if transplant is needed within the next few years, that will be a concern for IRCC.

No the nephrologist said if needed she is eligible for right away based on age and other medical conditions

But how

is that fair as I have achieved all qualifications they asked for….
I don't understand your question. Your wife must pass the medical for PR.

No I am saying when someone passes all the qualifications they needed but the spouse didn’t why it matters for the other applicants??? Thinking from IRCC perspective.

Hopefully the nephrologist did not say this in the letter.
