Hello everyone,

In a tricky situation. When my mother came to Canada a few years ago, we submitted her refugee claim and have been waiting for a hearing date.

I did not know this but my brother had received an invitation to apply for PGP and submitted the application to sponsor her. He was in the 2020 pool.

Will the refugee claim be cancelled or vice versa? If we withdraw she would be out of status while waiting for the sponsorship.

My brother should not have applied but it’s done and we’re not sure what to do. Just wait it out?

When did your mother get invitation to apply for PGP? When did she apply for PR because she would have know about it and didn't tell you? Your brother did nothing wrong as submitting and getting PGP is the better way then claiming aslyum. Should be thanking him for submitting a profile in 2020.

She should absolutely not withdraw the refugee application. If she does this, this will activate a removal order. Having the PGP application in progress would not be guaranteed to prevent her from being removed from Canada.

She is classified as being in Canada without status as a result of the refugee claim. You need to speak with an immigration lawyer to find out whether PR can be granted to her through the PGP program while she is in Canada without status. That is the key question.

Brother expressed interest in 2020 and was selected in May 2024. He submitted the application within the deadline. My mother is elderly so we take care of her applications and government related things. I don’t speak to my brother often and he did not tell the family he was sponsoring our mother.

We’re worried that the PGP may be cancelled because of the refugee claim which would be devastating given how hard it is to be selected.

Is the only option to withdraw and have her return to our home country whilst the PGP is being processed? The PGP is much easier to obtain vs going through the refugee claim and we have a higher chance of success.

Your mother would have signed the application, completed the medical, given all information to complete so she would have know about it. You too if you say "we take care of her applications." Don't cancel either.

As mentioned earlier, speak with a lawyer to understand what your options are before you do anything. This is a unique situation.

How exactly has your brother been sponsoring your mother without you finding out until recently? At this point a medical has likely been requested for the PGP application and your mother’s signature and other information would have been required. How has this been possible if you have minimal communication with your brother? He is also sponsoring her not you. Do you live in the same city? Has she been visiting and then staying with your brother as well waiting news regarding her asylum claim? The government cracking down on who can apply for asylum can’t come soon enough. It is not a substitute for PGP and costs taxpayers a small fortune everytime people file unnecessary applications or applications with no grounds. You should actually be thanking your brother for applying for PGP which is the only true way to sponsor a parent.
