CEC Work Experience and Company Existence Issue. URGENT!

Hi,

I need your suggestion or thought on my issues with my PR application. Any suggestion will be greatly appreciated.

So here is my story.

I Submitted my application for permanent residence on Sept 2012. I received an email from OTT pilot immigration last night (Sept 11, 2013). The content of the email is basically telling me that they are not satisfied with my work experience that I declared and according to "Open source verifications", my company that I worked for doesn't exist. I don't understand what that means. How can I work in a company that doesn't exist in the first place? Well, I worked as an accountant for that company for less than a year (in term of days in a year), but my working hours had fulfilled the minimum requirement.

Now, The immigration of Canada wants me to demonstrate that:
1. I was working for an existing employer
2. I was working in the capacity declared
3. I was working for sufficient hours to qualify

So my question is what kind of document do I have to prepare to address these issues?

If you copy and paste the letter in here - removing all personal info then people might be able to help.

A couple of my immediate reactions:::
1) you worked there for less than a year could mean rejection even if you meet the hours. The year is the minimum part - the hours are there to ensure you are working in a full time capacity.

2) it sounds like you didn't include a reference letter from your company? This should be on letterhead and I attached the business card of the signatory too. Did you do either of these?

3) do you have any pay stubs that you can send in support of the existence of the company? This plus any information (brochure, website) that proves the company exists would support your response.

The main issue - and others will correct me if I'm wrong - is the fact you worked less than a year. I'm presuming you applied under the education stream? As I understand it, you HAVE to work a year PLUS the minimum hours required. Ie doing a 70 hour week for 11 months won't make you eligible

Agreed. This is your main problem. If you didn't work a full year in days, then you don't qualify for CEC.

I'm curious - is there a precedent for this? Ultimately they are looking for a certain number of hours. Has anyone who worked fewer than 12 months, but worked particularly long hours each day, qualified for CEC?

In any case I wouldn't want to try it on.

Well the eligibility page on CEC site talks about having at least 12 months experience of full time experience. There have been people rejected due to falling short

I thought pre-jan 2013 if you applied via the education stream you needed 1 year of education plus 1 year of experience? 2 years was the other non-education stream.

The requirements are very specific. You need to meet BOTH the hours and also the 12 months minimum. Just meeting the hours is not enough. And yes, we have seen people here refused who met the hours but not the days. Just because you worked 60 hours in one week doesn't mean that you can count this as two 30 hours weeks. For CEC, this only counts as one week of full time work.

One full year is the minimum requirement.

One or more of the following:
- (As suggested above) Articles of Incorporation
- Copy of business license
- CRA business number

2. I was working in the capacity declared

- Names and contact info for people who can verify your job duties
- Another Letter of Employment
- Any other documents with your name on it that could verify your job activities


3. I was working for sufficient hours to qualify

Timesheets / paystubs if they show the number of hours worked per week OR
Record of Employment (from Service Canada).

Again, you should be prepared, if you worked fewer than 1 year/ 52 weeks, you will not have met the 1 year requirement, no matter how many hours you worked. You have no choice but to try tho, you might get lucky, stranger things have happened.
