Bridging Open Work Permit (BOWP) under express entry - connect here

Hey Guys

I have two quick questions. My work permit expired on July 1, 2016 and I applied via paper application for a Bridging Open Work Permit shortly before then. I received a refusal letter in October 13 detailing I need to be in process of PR for the BOWP and that I have 90 days to restore my status. My questions are:

a) Does my 90 days to restore my status start on July 1 my initial work permit expiration or October 13 when I got the refusal letter and lost implied status?

b) I've received an ITA and applied for PR in November. So far, I've received my AOR but my eligibility is still in review (i.e. haven't passed R10 completeness check). Can I apply for the Bridging Open Work Permit with the first AOR when I submitted my PR application or do I need to wait for the R10 completeness check?

B) It's tricky, I would say call an immigration or a lawyer

I already answered your questions in the other thread. Unfortunately you are not eligible for BOWP because you don't have a valid work Visa

That's odd because there is a restoration fee which i would have to pay for an expired work permit and it stated this in the refusal letter. i wanted to see if others had any suggestions.

I just wanted to know if the 90 days started on October 13 and if i can use the first AOR i received when i applied for PR.

try filling in the questionnaire online to know your eligibility, there it will ask your date of expiry of work permit and if it says you are okay to restore and okay to pay , then i think you would be able to extend it in your case.

Restoration of status it's just a term. It means restoration of any type of status you are eligible for. Visitor, work, study... Currently you don't have any status. It means you have 90 days from the date of your refusal letter (if it states that). Restoration of status doesn't mean you can get back your worker status. You would need LMIA for it. You can get visitor status if you have sufficient funds.

Rules for BOWP eligibility are clear. At the moment of applying you must have a valid work Visa.

Congrats! I think that having your BOWP approved is a good sign that your PR application will not be rejected

When we apply for BOWP and get a one-year open work permit, is it valid even if our PR file gets rejected for any reason (like missing documentation)? My boss asked me if my file gets rejected and I have to apply again, can I still work? is there anywhere CIC has stated that I can?

i am working with an employer in NOC class B but yesterday i got job offer to start on january 2,2017 from another company (no LMIA in both same NOC)

1-if i will apply by paper for BOWP before the wp will be expired ,can i work even if my work permit and SIN are expired ?on implied status
2-anyone has all the information for applying the BOWP by paper ? without an AOR just to win some time until i get the ITA
3- is the COmpany still can apply for LMIA just to support my PR application !!if yes, i will get 50 points !!!what is the prossecing time! for LMIA supporting PR!

You will get implied status unless they reject your BOWP application as incomplete (since you don't have a submitted PR application at the moment of applying). In that case your implied status won't be valid retroactively. However, mostly they refuse and not reject, that means you will be good to work until the decision will be made.

You can apply but there is no chance to get it approved. You have to attach the first AOR letter to the application what you get after you submit a PR application. Even if you attach it later the chances are really low.

I think they can apply if you work only with legal status. LMIA can take up to 3-4 months

hi did anyone experience having 'On Hold' status in applying BOWP? I apply last Nov. 20 and when I open my application in My CIC account in BOWP, my status change to On Hold?
