just want to update that I resent my application which was returned on Dec. And it delivered and arrived on Dec. 24th. Sadly, haven't been CC-ed yet.

I haven't checked this thread often recently, since I'm working on submit my initial dissertation by this Monday. The PR application thing seems doesn't go well, see a lot of rejections in the sheet. Sorry to heard about this.

Could you please share with us your NOC code and the duties on the reference letter to see how they assess these documents?
It will be helpful for those who are preparing their application.

Did you check the NOC code with the duties listed in your letter? Are you sure they are right about that? You have about 10 days to appeal the decision to the federal court! So think about that, it will be shorter than applying again.

If you think you can prove that your work experience matches with the NOC code, then you have 15 days from the date you are informed of the officer's decision to appeal.

BDW, it would be wise to consult with an immigration lawyer to get some clear idea about that, as I'm not an expert and just giving you some ideas from what I've heard.

Just if you don't mind, share the noc code and the duties you included in the application as we might face somehow similar problem.

I used the old version of NOC codes when I applied. My NOC for RA/TA was 4122.
My TA duties was Conducting undergraduate laboratory, Leading tutorials, Grading lab assignments, Marking mid-term and final exams. They actually accepted my TA duties.

My RA was Conducting and Studying ...... in the field of ..... . They disagreed with my RA duties and rejected me because it didn't match the NOC duties.

I also claimed the previous work experience in my back home. I couldn't find the exact NOC match with my career. However, I used the nearest NOC to my work experience. They didn't accept my previous work experience as it didn't match the NOC code.

I don't know how the CIC officers think about the PhD students. Why we need to exactly provide the letter that describes the RA duties of a PhD students like what they mention in NOC duties. OK, We just go to university and watch soccer and play game and check Facebook. Even my grandmother knows what I am doing in the lab. It is clear. we do research, conduct literature review, prepare lab equipment, ..... The CIC officers are all douche bag.

You should not assume they will know what you do. There are thousand of professions. Being a PhD student/candidate will not give any advantages during processing. Will be submited to the same processing as everyone else. DO NOT EXPECT ESPECIAL TREATMENT.

I don't know. Any knowledge I have is only about the application and things we discuss here. But I would assume that if you can, you are not going to fair well because they will surely have one, a very good one.

I'm not sure how this will work, but will finishing your PhD at least now guarantee you the 5 adaptability points for previous study? phdapplicant got his application re-open after one of his relatives became a PR AFTER he submitted his application (meaning that he's eligible for 5 extra points). Will finishing PhD work the same way too? I know that adding work experience gained after application date won't work though...

Yes, phdapplicant's case was the one I actually had in mind. And you're right---I was trying to secure those 5 adaptability points, because it's still not entirely clear how Ottawa CPC treats them. Anyways, I guess it doesn't hurt to give them a little update.

I got exactly the same reply you got a week ago. But the case for me was worse. I updated my RA and work experience and the duties in a second letter sent 7 months ago. It seems they didn't care about the second letter, or they lost it!

Are you considering an appeal to the Federal Court?

Seems like CIC only looks for reference letter in the same way as given in NOC structure.....

I do agree with you. If I were you, I would definitely appeal. Because, if you are single, reapplication will cost you at least $600 considering side costs (even more, photo, post, pcc, ....) plus on average one year of your life. Also, as you are international student you must pay for health insurance which is varying between $500-1000 (in my case it is more than $3000 as I am not alone).

So, if you even pay $2000, I would say you win, cuz you will be one year closer to citizenship with the almost same cost.
