I have a friend who apply to extend his work permit without having LMIA yet,he call and spoke with an agent and they said he can apply to extend his work permit if his boss has an LMIA application in process. And the agent said they will put in hold his application for 2 months,they said he has 2 months to provide LMIA number.Now just wondering if somebody knows will be 2 months+ processing time? Or just 2 months. Coz processing time was 69 days,he apply on paper.And now he don't know if he has just 2 months to provide LMIA number or he has 2 months + processing time....

He should assume he has 2 months to produce an approved LMIA.

this is what i don't understand....if he will not be able to provide LMIA number in 2 months he will be decline after 69 days(processing time)?

He has 2 months to provide LMIA approval number.. after 2 months of without it the application will be refused.. that show on CIC website.. and noted/written on the letter recieved from CIC when I applied for my work permit online when I was waiting for my LMIA. I got my Approved LMIA and gaved it to them through phone.. same day they process my pending work permit application and approved it.

*Employer has to advertise the JOB for atleast 4 full weeks before/prior applying for LMIA and the ADS should continue and researchable until the decision is made (JOB BANK and 2 JOB online sites or Paper ads)

*LMIA processing time varries from 8 weeks up to 20, 30, and so on weeks.
 
this 2 months start with the day when they receive his application? and how long until he will get rejection?coz it's seems... he does't have any chance to get this LMIA in 2 months.....if processing time will be 4 months...
 
You can only submit your application without a Labour Market Impact Assessment (LMIA) or Certificat d'acceptation du Québec (CAQ) if your work permit expires within 2 weeks. You must include proof that the LMIA/CAQ request was made.

You must:
•include a copy of the application sent to Employment and Social Development Canada/Immigration Québec, or
•include a copy of the receipt confirmation number, if the request was done online, or
•indicate, in the section Details of Intended Work in Canada of the work permit application: ◦the date the LMO/CAQ request was sent,
◦the office it was sent to,
◦the employer's name, and
◦the confirmation number for the submission, if available.


You must contact our Call Centre with the LMIA/CAQ confirmation number within 2 months of the date your application was received; otherwise your application could be refused.

I assumed its imposible to get an approved LMIA in 2 months because the advertising procedure is mandatory and a MUST.. my employer started an application and ads from month of MAY2014.. then repeated month of OCT2014.. Approved JAN 23, 2015..

Read some threads in this site and you can get some of goods advices and ideas, some of em waiting more than 26 weeks or so.. Advice your Friend to start processing approriate paper works with his employer.

Yes thats right.. date when they revieved and opened the application.. no one knows when CIC will send a letter or email to him..
 
his boss has an application for his LMIA in progress he send the application but just with few days before my friend send the application to expend his work permit....so anyway my friend has 98% to be refused...,right?

your case was an happy case coz you get the LMIA in time but i/m interested how was working for somebody who was refused coz it's seems this will be my friend case.... thanks any way for your help
 
Your friend is almost guaranteed a refusal (unless the LMIA somehow gets processed extremely quickly). It was extremely poor planning on his part to leave the LMIA so late.

If the LMIA is approved within 90 days of the refusal, your friend can apply to restore his status back to a valid work permit along with the approved LMIA. However note that he will have to stop working as soon as the refusal is received and won't be able to start working again until he has a new work permit approved.
 
I think you right Scylla....and also my friend knows he does't have to many chance to get this LMIA in time...now he is wondering how long after this 2 months he still can work( after how much time he will get the refusal letter?)....because he knows he has to stop working after refusal....
