@ Cher, sending hugs your way. So sorry to hear you lost your ADR. To be honest with you, I would not take them at their word that it takes 3 years for a full hearing unless you have independent confirmation from another source it is the case.

I don't know if you have thought about this yet, but considering the issue is that you didn't travel abroad while injured, etc and you have medical proof and reasons why, I really believe you should consider writing a letter to your MP and the minister of immigration about your experience with this ADR. Discuss it with your lawyer and see what she says. I know most people fear 'retribution', etc but that is exactly what they hope you will be afraid of and seriously, you have nothing to lose at this point.

Also, was the ADR just with the lady and minister's counsel? Is there a way to proceed with full hearing, and still re-apply? Disgusted!!!

my lawyer looked into it and yes its a 3 yr waiting period for here.. My lawyer thought we might have a good shot at applying again as it will be shorter wait time i swear this lady had her mind made up and she was so unorginized it was awful she only asked me about my ex husband nothing about my daughter relationship with him asked if his mom spoke english if not how did i commicate with her DUH she knows my husband speaks really good english i am so confused and hurt by my country that i am beyond words

It means alternate dispute resolution... Its kinda early resolution on ur appeal... It happens if you have only 1 or 2 issues for which ur rejected else u get full hearing!!!

I cannot believe that it is a 3 years waiting period. I think your lawyer might be wrong and I would look into that more with the help of another professional. Did you hire a very competent lawyer for your case? I read all your past posts and it is my understanding that you met your husband only once in person and it was during that visit that you got married? You never visited your husband before and after marriage? I know it is hard to win an appeal if you have visited your husband only once...
 
no i visited him 2 times just got back in sept my lawyer advised i go back and yes i have one of the best lawyers in halifax its because i lost the proofs of our first meeting my computer went down i tried to get a guy to get it but couldnt i have proofs fron jan on we met online in nov ... my phones was no good to this lady she never asked me nothing about my husband

Hi there, it looks like I will be joining the group sadly. My wife's visa was rejected so I will likely appeal.

I have one question I have not seen answered yet and am curious about. The VO gave all of our proof back to my wife at the end of the interview. Is that normal?

My wife also told me the VO did not look at any of the documents my wife brought with her to the interview, which included some stuff after we applied. It almost seemed to me the VO had decided before the interview to reject my wife.

Thanks, and my heart goes out to everyone who is stuck in this mess trying to be with the people they love.

did VO told her she was rejected? how do you know she was rejected?
I don't know how its works with giving back proof because some one said they were approve at the interview and all the proof was given back to them after the interview

First of all I wish your spouse get the visa. Second, yea it happened me in the same way as with ur spouse. VO returned all the proofs and then surprised me by sending a denial mail.:(

But I pray for u and ur spouse that u guys dont have to face this nightmare. Stay blessed.

Yes, the VO said she was rejected. Not enough proof to show genuine marriage.

It was the Hong Kong visa office, and I am in Toronto.

I am just looking to start gathering any additional information that might show that the VO did not rule by fact. I don't like that the VO did not consider any new documents my wife brought to the interview.
