PR Card Renewal

Hi!
We ( me, my wife and my daughter) landed in July 2014 and were issued a PR card that expires on 31 July 2019. In 2014 we stayed here for two months and went back to to Pakistan to settle things and finally come back to settle which unfortunately took longer than usual and finally we were able to make it back to Canada in July 31st 2018 my daughter as started University here in London we have bought a house here too. My wife and i have been looking for a job which has been more difficult than we thought i Have some unfinished business in Pakistan which needs to be taken care of and may require me to visit more than once. from what i understand i have not completed the residency obligation of staying 730 days to be eligible for renewal of PR card and i did not know at that time and was made aware of it at the airport this time when we came. so kindly advise me about the possibility of PR card renewal application. what would be the possible outcome.

If you try applying for a PR card renewal having not met the RO then you could open yourself up to having your PR status revoked. Having not met the RO in the 5 years since initial landing then every time you enter you could be reported leading to your PR status being revoked subject to appeal. After the initial 5 years from landing the 2 out 5 needs to be met afresh in the 5 years preceeding each new entry.

As a PR you would still be entitled to enter the country but that is the risk you will be taking each time especially if as you say you were made aware at a previous entry there is always a possibility a note has now been made in the system.

Basically you need to stay put until you meet your residency obligation again otherwise as said there is a risk losing your PR status.

Yes a note was made during my last entry however the officer did not retain my PR card and deferred all the questions for when I apply for renewal. I have 10 years visa for US and if they dont renew my PR card then I intend to travel back via US in private car. Is that workable and how many times can that facility be availed. If they do renew my PR card I intend to complete my RO and apply for citizenship. How can I prove my intent. I have bought a house here and my daughter who is 19 is studying here and my wife is here now permanently and they will stay here I have to travel back to find and income which I cant develop here since everywhere I go I am faced by a wall with no way out. Cant survive like that. What circumstances ca. Help me e plain my situation to CIC and Will hiring an immigration lawyer help in any way in my situation

There's really no easy solution to your situation and hiring a lawyer won't help.

You cannot renew your PR card until you have lived in Canada for two out of the last five years. If you try to renew your PR card without having the required number of residency days, your PR status will be revoked.

You will be allowed to travel into Canada as long as your PR card is valid. However it's possible that you could at any time be reported for failing to meet the residency requirement. If you cannot remain in Canada without leaving until you have the two years to renew your PR card, then you will have to risk leaving Canada.

Once your PR card expires, you should expect things to get a lot more complicated and you should assume you will lose PR if you cannot remain in Canada without leaving. If you lose your PR status, your wife can sponsor you for PR once she meets the residency requirement.

You were lucky and were able to enter last time. You could have easily been reported. Given the note in your file expect the reporting is highly possible next trip.

You are right the officer said that ours was a cessation case and he is not taking any action against us at that time he is deferring all the questions for when we apply for a renewal. I told him that I have some unfinished chores to take care of In my country for which i may have to go back once or twice and this time we have come to stay for good now. Then we bought a house here and my daughter started university here and my wife and daughter have no plans of travelling anywhere for next three years. It's just me who has to manage a few things back in my country for which I needed to travel once or twice.

The argument will be that you stayed out of Canada 4 years for that and we already gave you a chance. Your choice to settle where a school is versus where you could find employment to support your family won't get you a lot of sympathy either.

I really appreciate your reply thank you for your time. Another thing if you can reply to. I have a visa for US and if I have to enter canada after my PR is expired. Can I enter canada by road on a private car from Niagra with my IMM 5292 CoPR from. And if u can than how many times is that possible

Same issue. You will likely get reported. They will look into your PR status. You can still enter once.

Well I can only hope that's not the case bcz I have burnt almost all the boats for my return and am planning to start a business here soon exporting wood to my previous home country but that will require time and some travelling back and forth.

Unfortunately when you don't meet the very lenient residency requirement there are consequences. Not sure how you didn't know the rule because it is the major rule of the PR system. London is a very odd place to set up a lumber export business to South East Asia.

Trading is possible from anywhere. Been doing that all my life it's just it needs lots of travelling initially and then it's just the computer and bank and office and occasional recovery or quality assurance trips.

Yes but London isn't even close to an International airport.
