H&C Humanitarian Ground with/or Without Failed refugee claim

This isn't the same thing as a direct H&C application. This refers to an immigration application submitted from outside of Canada through a regular immigration stream where someone has requested H&C consideration. So let's pretend that you were selected through the parent/grandparent sponsorship lottery - but know your mother is going to be refused due to a health condition. You could submit the parent/grandparent sponsorship application all the same AND also request H&C consideration. So requesting H&C consideration (as mentioned in the link above) is certainly doable for you, but you would have to do this as part of sponsoring your mother for PR through the parent/grandparent stream - which first requires you to be selected through the lottery.
If you want to apply for H&C directly (i.e. submit an actual H&C application), your mother must be in Canada. This stream only has an in-Canada option.

So if I bring my mother into canada on visitor visa, then she can apply for H&C? I read somewhere that people on temporary visa are not eligible?
Yes - you can bring your mother on a TRV and then apply for H&C.
Not sure where you read that people on temporary visas aren't eligible - but that's incorrect.
One thing... Be aware that she won't qualify for health care coverage until she has first stage approval in the H&C application. First stage approval seems to be taking around 8 months these days. So you either have to obtain private insurance coverage for this period of time or pay for any care she needs out of pocket.
Thanks Scylla and Bryanna for clarification, I can relate my situation a bit , my mother is here with me in Canada , I’m her only child and we have no one in our family.as I had a lot of hardships here ,also a medical issue too so thought I can have my surgery soon as my mom is with me .Since my mother’s arrival, my life has changed drastically.last year I applied for her through h&c unfortunately but unfortunately this year she has diagnosed with cancer , thank God she had insurance so she had her surgery now preparing for rediation therapy, insurance was expired after the surgery so now no more coverage from present insurance as it doesn’t cover the pre existing condition, I informed cic about her medical emergency but they didn’t care about it at all , you can’t imagine how I spent my days since I got to know about her cancer , i went to so many places for medical help , no one helped me , even this gov doesn’t care about you even though you have the life threatening sickness. My lawyer said if I inform to cic that I am unable to pay the medical expenses it might take to direct refusal so I didn’t knock again , I would suggest never apply through h&c if your mom has this kinda sickness . My situation is different , somehow I have overcome this situation. I am truly blessed to have the best onchologist for my mom here in Canada , his team supported me a lot even didn’t take money for so many visits still I scare what’s coming next , how many hardships I have to face , I forgot about my surgery now all I care for my sick mom who is recovering by the grace of God . So please don’t drug your moms life in this situation, it’s hard to wait already 9 months passed still I am waiting for a positive respeonse . I hope for your mother’s speedy recovery.

Yes you are very lucky that your oncologist is not billing you for the full price. The taxpayer is then still covering some of the cost. Hopefully you will get the response you want but you will still have to be prepared for other costs. For example if you mother ends up in long term care you will have to pay over $1000/month for her to stay there. I wish the government explained a bit better about the potential costs you could incur when bringing elderly parents to Canada.

Thanks for your kind reply. My mother already got her treatment plan , after the rediation she will be taking a medicine daily for 5 years . And every 6 months follow up with the doctor . That medicine costs only around 35$ per months. Till now I paid everything with the help of my insurance. Right now I am preparing to pay for rediation which costs 18k . After that only the medicine which Doc already prescribed. Two years ago my mom came with super visa. Few months ago she discovered a lump and it was cancerous.My mom is not even 50 years old and she is very active and strong even though she had breast cancer It was her beginning of stage also she has no other health issue . Sorry couldn’t get the 1000$ month ? Could you please explain?

People don't realize that individuals in longterm care pay for their beds through their pensions. If parents don't receive a pension family members are expected to pay for their stay in longterm care or a hospital bed if they are waiting for a bed and stuck in the hospital unable to be discharged. If your mother is young and able to care for herself, stable and likely just taking tamoxifen I don't quite understand why she would qualify for H&C?
government well explained about the medical cost that’s why they added buying medical insurance for all parents while applying for Canada , because but how do you when you can get sick , have I ever known my mom will have cancer ? Never . For H& C there are several reasons for apply , it’s not like that your parents are so young so they won’t qualify, they might have hardship maybe life in danger in back home or their children could be in a bad situation in Canada so need they each other’s. Based on all situations the officer will decide whether that pérson qualify for this ground or not . Apart from all negativity let’s cross our fingers for something positive.
I cannot even imagine the stress, the feeling of helplessness and the hardships that you and your mom have gone through. Only someone as brave and optimistic as you could have endured all this.
I believe everything happens for a reason. You went through a long stressful wait for your mom's super visa. And, then she was approved. She is lucky to be with you now when she is going through the treatment for cancer i.e. when she needs your support the most. It would have been so so difficult if your mom was alone in her home country at this time.
Don't lose hope even when the situation seems terribly challenging. Do remember there's always light at the end of the tunnel.... no matter how long and dark the tunnel is.

I am just pointing out that you and your mother are relatively young and you were aware of her living situation when you immigrated. I feel like many use H&C when they don't get selected for PGP. It is not me to decide though. Wish you the best. If your mother only needed surgery, radiation and tamoxifen she was very lucky and had stage 1 or 2 cancer which has an excellent prognosis. I applied for H&C last year on january by my own on best interest of a child ground.
7month later, without any AOR, I got a call from CIC to update my file and we talk for about 30mns about my application and familly. I receive AIP (Approval in principle) 1 day later.
Since the AIP I didn't ear any news from IRCC until january 2018, I received médical request and Annex A request. it's was all done by the end of january and my background still in progress.
and I still waiting....
Did you get any new about your application since you done required documents such as medical and background check.

No unfortunatly, no news in my side since middle of june when IO ask for my passport biographic pages.
Actualy my background check still going on, only criminality is completed. Security screening still in process by CSIS (got a gcms notes from them few weeks ago).
So I don't expect any news on near futur, I know how slow they can be at this stage.
