Good day @legalfalcon

Thank you for all your valuable advice. Would just like your opinion on the expected timeline for my application for my wife (primary applicant) and myself (dependent) after submitting the ADR documents post change of circumstance (got married after PPR was requested for wife (primary applicant)

Category: FSW-O (Primary applicant (my wife))
AOR: 24-Mar-20 (Primary applicant)
PPR request: 18-Mar-22 (Primary applicant)
Notified IRCC of Change in Marital Status: 12-Apr-22
ADR requested: 31-May-22
ADR submitted: 23-Jun-22
Acknowledged receipt of docs: 28-Jun-22
Biometrics: Not yet requested

Based on recent trends this year. How long do you think it would take to pass the eligibility, medical, security and background checks?

Appreciate your opinion as we would like to make some decisions in our career and life over the course of this year and would just like to get a fair opinion on an expected timeline to PPR assuming all documents are in place and no additional documents are requested.

Hi @legalfalcon

I got my PPR on the 22nd of April, 2022, with medical passed status on the 20th of April 2022. Got stamped passport and Copr on the 11th of June with online profile showing approved with counterfoil.

On the 21st of July, I saw profile updated email notification, checked my cic account and noticed a new pass date for medical, July 21st, 2022, counterfoil disappeared with Eligibility and Final decision showing in process instead of Approved.

What could be the cause of this change? Could it be a technical glitch?

I am already set to travel to Canada very soon. Please advise
Give it a few days and if it is not approved, you should contact IRCC. However, if your have been issued a COPR, without notification it cannot be cancelled.

@legalfalcon Hello sir, hope you are in fine spirits.
BC PNP Nomination done in November 2020
Express entry AOR February 2021
When I submitted application I attached positive WES report,However in march 2021 I received message from ircc to submit WES report again,So I send WES report again. In October 2021,I received email from WES that they have initiated secondary verification for my masters deegree, although I didn't receive any message from ircc regarding this. As the university from which I did masters ,some 12 years back,is facing some controversy recently and matter is sub judice,so they are not replying to WES reverification emails.
Now recently when I checked my WES account status shows Inactive. Already I had submitted positive WES report with my file. Sir my question is will the positive WES report which I submitted will be considered final? Because university is not responding from last 10 months and wes status now shows inactive. I received re medical in april 2022 and medical cleared on 6 june 2022. But still I didn't received biometric request.Sir plz guide.
The WES report is the final, conclusive evidence of your education as per regulation 75(8) of the Immigration and Refugee Protection Regulations.

75(8) For the purposes of paragraph (2)(e), subsection (2.1) and section 78, an equivalency assessment is conclusive evidence that the foreign diplomas, certificates, or credentials are equivalent to Canadian educational credentials.

Unless your WES report is revoked, you need not worry.

No one can give timeframes. Each application is processed on its own merits, and even if you have everything easily set out, two very similar applications can have very different time frames.

Instead, keep a check on what stage your application is at and what all is pending by requesting your GCMS notes or calling IRCC.

Hello @legalfalcon

Could you please clarify till when medical is valid-

1) 12 months from the date on which medical has been done (medical was done on August 19, 2021)? or

2) The date till which medical is valid on the file? (Email from IRCC - Medical examination results are on file and valid until September 5, 2022)

Thank you.

Hello Legalfalcon,

Hope you are well. I am posting a question for you after a long time. I sponsored my wife and daughter back in 2019. They became PR together in May 2019. Recently while filling out their citizenship application forms I noticed that on my daughter's COPR document my name is mentioned as a her 'sponsor'. However, in the relationship field instead of 'father/parent' the form states 'spouse'. Is it normal?

I was wondering if they mentioned it in this way on COPR because it was a spousal sponsorship, and my daughter was our dependent that the form mentions the same sponsor information for my wife and daughter. My wife and daughter had their interviews at Etobicoke together and got their COPRs together after the interview. I don't quite recollect if I noticed this issue at that time and spoke with the immigration officer. Please let me know if this is normal based on your experience.

Your kind support will be highly appreciated.

Hi @legalfalcon your advice is appreciated.

I applied for PR in Sep 2020 via SINP with restrictions on employment with Company A.

In 2020, I filled in the Personal History aligned with my work permit location. However, based on fact, I worked on a different locations/branch, with the same company A.

Now after almost 2 years, I received ADR for Schedule A and I filled in the form based on facts. Thus, not aligning with the Sched A I submitted last time.

However, there are some periods in that I did not meet the conditions of my work permit(such as location or job title). Though, I only worked with one employer throughout my stay in Canada.

What will be the effects of this? Is this considered as misrepresentation?

Hi @legalfalcon

Hope you are fine. I landed as a PR of Canada on March and had to return back to my home country in April due to some urgency. I received my PR card and will be going back to Canada within next 2 months. I am thinking of applying for my parents visitor visa before going. I am the only child of my parents.

Considering my above scenario, can i apply inside the "Family Reunification" criteria for the visitor visa sir ? What might be the strongest purpose for my parents to apply for their visit visa?

Actually I am very close to my parents as I don't have any siblings, so in order to settle down in Canada initially I really need my parents to be with me to have emotional support.

Can you please advice me as above? thanks sir

@legalfalcon We just recd our RFV request today and expect that it will have an expiry of March 2023 (our current medical exam was passed on March 9, 2022). However, we are expecting our second child in Oct/Nov 2022; will IRCC re-issue COPRs with longer validity if we do upfront exams for all of us in Nov/Dec 2022?

We believe that March 2023 will be too soon to travel with a newborn so wanted to know what can be done in such a situation.

Hi Legalfalcon,

I received COPR and is going to expire by 31 Mar 23. Being the principal applicant (myself), I need the clarifications on the below

1. Can I land on 02 Mar 23, is it too delayed for the issued COPR validity 31 Mar 23. Hope there would be no issues in the immigration Canada Airport.
2. My Family will land on the same day but they have to return back to India by 15 Mar 23. Does this create any issues and they will return after 6 months to Canada?
3. Hope the PR cards will be delivered for my family along with my PR card in Canada as I will be there in Canada from 02 Mar 23 to collect their PR Cards. If so, then I have to send it to them in India by courier to return back to Canada.

Looking forward to your kind reply in this regard.

Your passport is within acceptable parameters and should be fine. However, if there are issues where the biographical page is being peeled off, that is when you should get a new passport before submitting.
Thank you @legalfalcon appreciate your response.
Actually, i had already applied after posting the question to you and I got my new passport with the help of urgent services, my question is --- now that I have the new passport, do I have to send both the passports (old and new) to the VFS Global office for Visa stamping?
Definitely, Visa will be stamped on the new passport however, would they need the old passport for references?

please advise !

Thank you and once again i am sincerely thankful that you take out time to answer our queries.

@legalfalcon - my medical is going to expire on 11th sep 2022
I had taken the medical test on 28th Aug 2021
As per the RFV letter, there is a note which says - please see text marked in blue.

"
Your Permanent Resident document(s) will expire one year after the date of your medical examinations or earlier if your passport or the passports of your spouse or dependent children (if applicable) expire on an earlier date.
You must travel to Canada and present your immigration documents at a Canadian Port of Entry before they expire. The validity of the Permanent Resident documents cannot be extended. If you fail to enter Canada before this date and still wish to immigrate to Canada, you must reapply by submitting a new application and paying new processing fees. All such applications will be assessed according to the immigration laws in force at the time of receipt of the application. There is no guarantee a future application would be successful.
"

Question ;-
As my medical test was done on 28th Aug 2021 and the expiration as per the IRCC agent is 11th Sept 2022
which date do I need to honor and land in Canada? the date the medical exam was conducted or the expiration date?

Please advise as many of my critical decisions like resigning from the existing job depend on this.

thank you !
