francohoosier: no worries. you still have a bit of time left! and if you run out of time, you can extend your work permit as a visitor permit, up to a month before it expires (or even postmarked or online just before the day it expires!). I just did the same thing, actually. then you are on "implied" visitor status until you get notice from CIC re: your visitor application (or if you get PR first):

of course, it means you can't work as a worst case scenario, but you won't be kicked out..

Thanks eletyl. I thought if you applied for extension, your current status was grandfathered as "implied status" until you heard back from CIC? So I could theoretically work until I receive their decision? Or is that not the case? ???

I think it's only grandfathered in if you are applying for the same type of permit - i.e. another work permit. if you are changing to visitor, then it's not grandfathered in. (I've read that somewhere, but unfortunately I don't remember where at the moment..)

francohoosier: depending on the type of work you do, you might also be able to get a work permit based on a job offer letter from your current employer.. if it is LMO-exempt, it would be easy. if you need a LMO, it could be a bit harder. I am not quite sure how that would work, but maybe someone else in the work permit forums would know better than I...

This does not apply to outland applications. Only inland and only when you send an OWP application with the inland sponsorship.

Exemptions from the HRSDC process

In specific cases under the Immigration and Refugee Protection Act (IRPA), employers in Canada can hire foreign workers without requiring an LMO. IRPA exemptions from the HRSDC/Service Canada LMO requirements are intended to facilitate the entry of foreign workers to support broad economic and trade objectives in Canada.

In the case of IT specialists, you should be aware that under the North American Free Trade Agreement, Canadian employers may hire American and Mexican citizens in the following occupations without needing an LMO:

Computer Systems Analysts with a Bachelor's degree, or a post-secondary degree, or a post-secondary diploma and three years work experience ;
Engineers with a Bachelor's degree or state/provincial license ;
Graphic Designers with a Bachelor's degree, or a post-secondary diploma, or a post-secondary certificate and three years work.
Foreign workers that meet the conditions above may apply for a CIC work permit directly at a CIC Mission abroad, or at a port of entry.
My title right now is "Multimedia producer" - but a large part of my tasks involves graphic design, and I do have a Bachelor's degree in "Telecommunications" which at my particular school covered everything from video/audio editing to photoshop, illustrator, and Flash.

Think this could be my ticket to a smooth process, or will they not accept it because of the different appellations?

I don't know how Canada deals with NAFTA permits, but I know that it's a separate visa class in the US (TN) that you "apply" for when you get to the border with your offer of employment and credentials. There are specific requirements for your existing experience and you must also show that the employment is temporary.

rjessome: last I checked, if you had some sort of status and you applied to renew it, you were under implied status for that during the renewal process. I.e. if you were admitted to Canada with a work permit and you applied to renew it at least 30 days before it expired, you would be under implied status of the original work permit until you received a response about the renewal.

This applies to visitor permits also.

I don't think you can change the terms of it in that process -- doing so is not a renewal but a new application.

Yes, but in the case I was referring to, the OP had thought that their application for outland spousal sponsorship would give them implied status and enable them to continue working as a temporary foreign worker. This cannot be done as the outland PR application has NO effect on the temporary status of the applicant. It will not extend it.

There are also specific conditions for EXTENSION of status. For example, a work permit may be extended if the employer has obtained a valid LMO for the worker. Or a student gets accepted into a new program of study so can use that to apply for an extension of their study permit. Also, you CAN change conditions of temporary status in Canada but it is limited. A visitor cannot change to a student or worker through an application made to Vegreville. They must apply at an embassy or consulate outside of Canada. However, a student or worker CAN change to a visitor through an application to Vegreville. It's not a new application but a Change of Conditions. Kinda the same but kinda different too.

I should also point out that an extension or change of conditions needs to be submitted before the current status expires, NOT at least 30 days before it expires. I know this is written on the website but it is not the law.

Hi All,

Just a quick update! Our family finally made it to Toronto on June 19. I was sooooo shocked at how easy the process was for us, seeing how our outland application is still in process in Buffalo. We (Canadian hubby, American wifey, and 3 dual citizen children) flew from California to Toronto's Pearson Airport. We went to customs and they referred us to immigration automatically because my husband stated he wanted me to stay with the family while we transitioned to Canada. The nice man said no problem I will have the immigration officer stamp her passport for at least 6 months if not longer. We were also traveling with an extensive amount of money of which no one ever asked to see a source of funds. We were prepare to show everything from sponsorship letter to a whole copy of the application we sent to Mississauga/buffalo. NO ONE ASKED for it! The immigration officer didn't even ask me a question, probably because I was caring for our three kids at the time. Out of the whole process the only little bump in the road was my son's luggage was lost for 24 hours, but it made it to us safely the next day. I don't know what I was expecting to happen if they refused entry at the airport. Hoping for the best but expecting the worst, all that worrying for nothing!!! So now we have been a family in Canada for a little over 2 weeks and so much has happened. Hubby got a job offer, we have just moved into an apartment, opened a bank account, got sin cards/OHIP for kids and dad, drivers license, a car and insurance! OMG Insurance is crazy, even with 8 years of consistent history. This was our biggest issue as we both moved from California. Our shipments made it safely across via UPS, so thankful!!

The only update on our file in buffalo is that Mississauga has confirmed receipt of our RPRF that we sent on 5/27/11 and confirmation was received on 6/28/11. Here's to hoping Buffalo gets their acts together!

Congrats Doiron!! you made it!! is good to hear good news about families moving to Canada. I wish i can travel with my son to Canada and wait there for the immigration process to complete. The worries about the border have me thinking about it.
