Not a problem as far as CIC is concerned. Your mother-in-law might want to let her bank know she's making a large charge if she doesn't regularly use the card. Also she's using it in Canada if she lives outside Canada.

Even if you apply inland, you can travel if he is visa exempt. He should be residing in Canada during the processing so you can not move but a vacation should be ok. I see very little risk of him being refused entry if he is coming back from a short vacation along with his Canadian spouse unless he is drunk and tries to hit the immigration officer or something like that.

For people who are not visa exempt, it is very risky to leave Canada during the processing because they face not being allowed back. If they have a valid TRV, they would probably be allowed to enter but if their TRV has expired and they have to apply for a new one from outside Canada, they are often denied and would then lose their inland application.
Thank you so much for the fast reply :) it really does help me make sense of all of this. He is a US citizen and thus visa exempt if i understand correctly and has entered Canada this last time as a tourist with only his passport. We will be getting married in Canada first and then travelling for our ceremony/honeymoon after the fact so will legally be married before we leave here, as well as have his inland application in progress.
He still has a temporary address in the united states but travels and plans to stay here in Canada visiting until the official marriage(and then abroad us and Costa Rica together after marriage) We are just worried we may get separated at the border if we travel regardless of being married, as he is not yet officially a citizen while we apply right?

As a foreign national he does not have the right to enter Canada. However, the officer refusing him would need to have a basis for the rejection. Further, while people say "it terminates your application" in fact it's not an automatic termination - it ties into the requirement that the applicant must be living with the sponsor in Canada. A short separation doesn't qualify as "not living". Further, if he were refused he can challenge the refusal. Given the seriousness of the penalty for that refusal the officer really would need a solid reason.

So yes, there is a non-zero risk. But he's more likely to win the lottery than to be refused without reason.

HI everyone,

Currently I am residing in UAE and working in a local bank. My wife (PR Holder) has sponsered me last year july/2012 for spouse immigration, UAE embassy asked to provide some additional documents in November, 12, which we provided in December, 12. Since then there is no communication b/w us and embassy. i checked it online where it appears "in process".

Can anyone tell me how much time it will take more as my wife is in canada and i am here we have been apart from each other.. she came to see me in feb, 2013 for onw month visit, now she back to canada.. it is so paining to live without your loving wife .. :(

Further, i am just curious. will they ask to cancell my UAE visa upon receipt of immigration?

Hi All,

I URGENTLY need some advise on my wife's spousal sponsorship application!

We recently got a PPR request from NDVO (new Delhi visa office) and we are going to submit the passport soon. We just realized today that our Police Clearance at the time of Application Submission was 4 Months old. Although the VISA office has not asked us to re-submit the Police Clearance Certificate, we are concerned that they may. We feel so because:-

1. There is a rule on CIC website, which says that Police Clearance at the time of Application Submission should not be more than 3 months old.

2. Please note that Police Clearance certificate we submitted explicitly stated that its Valid for 6 months from the date of Issue. It was issued on 31-Aug-2012 so technically it expired on 28-Feb-2013. Our application processing started on 31-Dec-2012

The whole police clearance thing in India is a relatively long affair; so a part of me says that for now I just submit the passport and take a chance on Police Clearance. A part of me says that I send the Renewed Police Clearance (if possible soon with the passport) or later.

Anyone faced similar dilemma? Please advise.

Anybody has ever encountered receiving a letter from Immigration asking for additional docs and at the end of the letter it says that:

IMPORTANT: TO FACILITATE EXPEDITIOUS PROCESSING, PLEASE RETURN

A COPY OF THIS LETTER (WITH BARCODE) AS THE COVERING PAGE TO ANY SUBMISSIONS YOU SEND TO OUR OFFICE

Im about to send them the additional docs that they asked and I cant find any barcode on the letter. Pls Help!

Include with that letter that you received no "barcode" with the letter they sent you. Make a copy for yourself in case they later want to claim that your file was delayed due to no affixed barcode.

We recieved an email 24 dec 2013 to pay landing fee and 40 day time for this .they told us if u dont pay in 40 days it means refusal. But our lowyer sent the money
17 th dec. But exactly after 40 days i cant check my ecase and there is no news anymore:(
My husband is in canada and i dont know what does it mean. Please help

Your question does not match your statement. You say that you have been together for 2 yrs, but only living together for 1yr by January 2014 (which is next year), which means that you just moved in together 2 months ago. Is that correct? If correct, for common law you have to have been living together for 1yr already so you might have to wait until January 2014 to apply as common law.

First, I'd caution you not to be too excited about the PPR from NDVO. They like to "request" you send your passport to them (they don't demand it) to "expedite processing" at the beginning of the process. Many people find they hold it for 4+ months.

As for the police certificate, it won't hurt your application to obtain a new one.

Usually visa offices take 3-4 months before they review additional document submissions.

Generally, they don't ask for the RPRF unless they expect to finalize the application. But they often will wait 3-4 months after such a mail before they review your application again. This is one reason why we often advise paying the RPRF up front, so that it does not add several months to the process.

I'd expect you'll hear something by next month.
