Hi everyone,

I really need help. I am a PR of Canada and living with my husband here. My parents deceased last month and I have my brother of age 20 in India. He is dependent on me for everything. He is pre-mature so he studied till 10th and due to that he can't work. I am looking for options what should I do so that I can bring my brother with me permanently? Because I am the only one left to take care of him. Can we apply for Humanitarian and compassionate program for him? Please suggest me friends if you have any solution

Unfortunately you cannot sponsor your brother through Family Sponsorship class.

To apply for H&C, he must be physically in Canada. So he would have to first come here on a visitor visa (or perhaps study permit).

Hi scylla.. Thank u for ur reply. I checked it on website and it says that we cannot apply for H&C if a person has temporary permit. Does that mean we can't apply if my brother comes on a visitor visa here? If yes then what is the meaning of H&C like they didn't left any option.. What do u think?

TRPs (temporary resident permits) and TRVs (temporary resident visas) are two completely separate things. A visitor visa is a TRV. This rule applies to TRPs only.

He's over 18 and that makes him ineligible.

You could've sponsored him with any age if you were single and didn't have any close relative in Canada.

But you're married.
